How Livermore Handles Business Licensing & Operations: A Practical Guide

Operators need a City Council-issued permit under Chapter 5.08 before opening, and the Chief of Police can move to suspend or revoke that permit for disorderly conduct or state-law violations on the premises.

Operating an adult bookstore or adult motion picture theater without a City Council permit is unlawful under § 5.08.030. Under § 5.08.130 the Chief of Police may initiate suspension or permanent revocation for permitting public disorder, lewd or intoxicated persons on the premises, conduct violating listed Penal Code sex-crime, obscenity or disorderly-conduct sections, drug offenses under Health and Safety Code §§ 11054-11058, or knowingly admitting anyone under 18. The City Manager holds an administrative hearing 10 to 30 days after written notice of the violation.

Massage Establishments

Livermore requires every massage establishment to hold a City permit under LMC Chapter 5.28, on top of state CAMTC certification for each technician. The chapter sets fixed operating hours of 8 a.m. to 8 p.m., bans breast massage without written consent and a doctor's referral, bans genital massage outright, and lets the Chief of Police revoke a permit for a single act of prohibited conduct.

The Chief of Police must serve written notice stating the grounds; the decision becomes effective 15 calendar days after service unless the permittee appeals under Chapter 1.22 LMC, which stays the effective date until the appeal concludes.

Compared to other cities, Livermore takes a harder line on massage establishments. The enforcement and penalty structure reflects that.

Towing Companies

Livermore requires a City franchise before any company can perform nonconsensual police-ordered tows under LMC Chapter 5.44. The City Council grants nonexclusive franchises through a competitive RFP process, charges a franchise fee set by resolution, and runs a rotational call list maintained by the Police Chief; the rule does not touch owner-requested or private-property towing.
