Operating, establishing or causing an adult entertainment establishment to operate without first securing the required conditional use permit is unlawful under IZO § 10.090(A). The Planning Commission can deny, suspend for up to one year, or revoke a permit under IZO § 10.110 for false application information, noncompliance with the zone or proximity rules, operating in violation of Chapter 10, failure to meet building, health, zoning or fire code requirements, or holding another suspended permit tied to the same applicant or a 10%-plus stockholder. Denial or revocation notice must be in writing, state the grounds and be served personally or by mail (IZO § 10.110(B), (D)).

Massage Establishments

Petaluma requires every massage professional to hold either a CAMTC state certificate or a city-issued massage permit, and practicing without one is unlawful under Petaluma Municipal Code Chapter 8.38. The police chief serves as permit administrator, background checks screen for specified Penal Code offenses, and massage services can only run between seven a.m. and ten p.m.

The chapter treats every violation, including each day a violation continues, as a separate public nuisance enforceable under Chapters 1.10 through 1.16, and the permit administrator can suspend or revoke a permit under Section 8.38.170 for any violation or any ground that would have justified denial.

Auto Repair on Residential Property

Petaluma's home occupation rules flatly prohibit running an auto or vehicle repair or tune-up business out of a residence. Section 7.050(F)(1) lists it among uses that can never qualify as a home occupation because of the equipment, outside storage, and parking demands repair work brings to a residential lot.

Operating an auto or vehicle repair or tune-up business from a residence without the required permit for that use elsewhere in the Zoning Ordinance exposes the operator to the same complaint-driven enforcement as any other unpermitted use: a complaint or the Director's own observation can lead to a cease-and-desist action, and because Section 7.050(F)(1) never allows the use as a home occupation in the first place, there is no permit to revoke, only the underlying zoning violation to correct.

This is not one of those rules that cities tend to ignore. Petaluma actively enforces its auto repair on residential property requirements.

Tobacco Retail License

Selling tobacco in Petaluma requires a city tobacco retailer's license for every location, capped citywide at one license per two thousand residents. Licenses run one year, must be renewed at least thirty days before expiration, and cannot be issued to a moveable business, a pharmacy, or a spot too close to a school or an existing tobacco retailer.

Operating without a valid license is enforceable under Section 8.21.160, which bars a violator from obtaining a new license for thirty days after a first violation within five years, ninety days after a second, and five years after a third, in addition to civil fines of two hundred fifty to one thousand dollars per violation under Section 8.21.170 and possible seizure of unlawfully offered tobacco products.

Compared to other cities, Petaluma takes a harder line on tobacco retail license. The enforcement and penalty structure reflects that.

Towing Companies

A tow operator cannot get on Petaluma's police rotation tow list without a nonexclusive city franchise agreement. The city caps the number of franchisees at three, sets eligibility to match CHP tow standards, and charges a franchise fee capped at its actual towing-program costs.

Operating outside a nonexclusive tow franchise agreement, or charging above the council-set maximum rate under § 11.94.040, puts a tow operator outside the police department's rotation program; the chapter's franchise scheme is the city's licensing mechanism for who may perform police-dispatched, non-consent tows within Petaluma, administered by the police chief and city manager.

Tattoo & Body Modification

Petaluma's Zoning Code classifies tattoo and body piercing studios under the "Personal Services – Restricted" land-use category, businesses the ordinance says may need to be dispersed because of potential adverse effects on surrounding areas. Table 4.3 permits that use in the MU1A, MU1B and MU2 zones but not MU1C. A citywide business tax certificate is required separately.

Operating a business, including a tattoo or body piercing studio, without the city's business tax certificate is a separate violation for each day it continues, under Municipal Code § 6.01.020. On the zoning side, running a "Personal Services – Restricted" use in a zone where Table 4.3 marks it not allowed is enforced as a public nuisance under Implementing Zoning Ordinance § 26.020, letting the City Attorney seek abatement and injunctive relief on the City Council's order.
