Pomona's Business Licensing & Operations: The Rules That Matter

Massage Establishments

Anyone operating a massage establishment or working as a massage technician in Pomona must hold a City of Pomona business license under Sec. 30-360. Owners holding 5% or more of a non-CAMTC-certified establishment must also clear a background investigation before the city issues that license, and every technician must carry current CAMTC certification.

Sec. 30-368 lets the director or city attorney revoke a massage license for fraud in the application, refusing or delaying a city inspection, employing an uncertified technician, prohibited sexual conduct on the premises, a criminal conviction tied to the article, or three or more civil penalties assessed within any six-month period; revocation follows the notice-and-hearing process in Chapter 50, Article VIII, Division 2.

Compared to other cities, Pomona takes a harder line on massage establishments. The enforcement and penalty structure reflects that.

Adult Entertainment

Pomona requires an adult-oriented business regulatory permit before operating, issued by the business license division after a Police Department background check and a planning division site review under City Code Sec. 30-236. Applicants must map every other adult-oriented business within 750 feet and every sensitive use or shopping center within 1,250 feet of the proposed site.

The city can suspend a permit for up to 30 days under Sec. 30-239 for any article violation, and must suspend it for refusing an inspection or knowingly letting an employee violate the article. Sec. 30-240 requires revocation for false application statements, allowing drug sales, prostitution, or specified sex acts on the premises, operating while suspended, delinquent taxes or fees, or an illegal ownership transfer; a revoked operator cannot get a new permit for one year, though the city can grant one after 90 days if the violation is corrected.

Compared to other cities, Pomona takes a harder line on adult entertainment. The enforcement and penalty structure reflects that.

Tattoo & Body Modification

Pomona zones a tattoo or body piercing studio as "Personal Services - General," a use the Zoning and Development Code permits by right, subject to standards, across RX1 through CX5 and IX1, with a conditional use permit required in I1 and I2. The same Code expressly bars tattooing from operating as a home-based business, so a studio must lease space in a qualifying commercial zone and carry a City of Pomona business license.

Sec. 50-336 makes it unlawful to conduct or carry on any business in Pomona, including a tattoo or piercing studio, without first obtaining a City of Pomona business license; each day of unlicensed operation is charged as a separate infraction. Running a tattoo or piercing operation out of a home under a home-based business permit violates the express exclusion in Sec. 550.C.8.c and can draw a code enforcement citation and permit revocation.

Towing Companies

Pomona City Code Article VIII, Secs. 58-671 through 58-675, requires any tow truck operator providing city towing services to hold a nonexclusive franchise granted by the city council, awarded through a competitive request-for-qualifications process run by the department of finance with police background review.

Operating as a tow truck company for the city of Pomona without a council-granted franchise, or transferring or assigning a franchise without the city council's prior written consent, is prohibited; Sec. 58-674 declares any unauthorized attempt to sell, transfer, lease, assign or otherwise dispose of a franchise null and void, on top of any general penalty enforcement available under Sec. 1-7 for operating outside the franchise system.

This is not one of those rules that cities tend to ignore. Pomona actively enforces its towing companies requirements.

Auto Repair on Residential Property

Pomona lets residents fix their own vehicle or boat at home under City Code Sec. 18-222(33), but only if it belongs to someone who actually lives there, visible repairs are cleaned up within a day, and major jobs stay inside an enclosed garage. Repairing vehicles for others, or working on a vehicle outdoors on non-residential property, is a designated public nuisance.

Key details: Visible repairs: Must finish and clean up within 1 day. Major repairs: Enclosed garage required. Eligible vehicle: Owned/registered to a resident of the property. Minor repair: Under 6 consecutive hours. Non-residential outdoor repair: Barred except under Zoning Code.

A violation of Sec. 18-222(33) is a misdemeanor under Sec. 18-221(d), subject to Sec. 1-7's general penalty: a fine up to the Penal Code Sec. 19 misdemeanor cap, up to six months in jail, or both, with each continuing day counted as a separate offense. Ignoring the abatement notice lets the city record a Declaration of Substandard Property or pursue civil and injunctive remedies on top of the criminal fine.
