Why Sunnyvale Has Some of the Strictest Business Licensing & Operations in the State

Massage Establishments

Operating a massage establishment in Sunnyvale requires a permit from the Department of Public Safety, on top of the standard business license. Every massage therapist must hold current CAMTC certification, and owners face a background check, fingerprinting and a felony history review before a permit issues.

Key details: Permit issuer: Department of Public Safety. Permit term: One year, renewed annually. Certification required: CAMTC certification for every therapist. Operating hours limit: Closed 10 p.m. to 8 a.m.. Revocation moratorium: Minimum 5 years at that location.

Any of 11 grounds under SMC 9.41.170, including a single violation of the chapter, disqualifying Penal Code convictions (Sections 266, 266a, 266e-266j, 315, 316, 318, 647(b), 653.22), sexually suggestive advertising, or using uncertified practitioners, lets the director suspend or revoke the permit after a hearing. A revoked establishment must cease operating immediately, and the hearing officer may bar any massage establishment from that address for at least five years (SMC 9.41.160(b)). The city attorney may also pursue nuisance abatement under SMC 9.41.200.

Adult Entertainment

Sunnyvale requires every adult business to hold a license from the Director of Public Safety under SMC Chapter 9.40, and confines these uses to the M-S and M-3 zoning districts. SMC Chapter 19.60 bars an adult business within 1,000 feet of residential zoning, a church, a school or a park, and within 200 feet of any other adult business.

Denial or revocation grounds under § 9.40.070 and § 9.40.100 include material misstatements on the application, failure to meet Title 19 location/zoning rules, building/fire/health code noncompliance, and knowingly permitting prostitution, lewdness, sex offenses requiring Penal Code § 290 registration, violent felonies, or controlled-substance felonies on the premises. The Director of Public Safety issues written notice and holds a hearing before suspension or revocation (§§ 9.40.110-.120); the licensee has 15 days to appeal to the city manager (§ 9.40.130), and the city manager's decision is reviewable in court under Code of Civil Procedure § 1094.8. No license fee is refunded on suspension, revocation or discontinuance (§ 9.40.140).

Compared to other cities, Sunnyvale takes a harder line on adult entertainment. The enforcement and penalty structure reflects that.

Auto Repair on Residential Property

Sunnyvale allows residents to service or repair their own vehicles at home only under tight limits set by Municipal Code Section 19.18.050: daytime hours of 7 a.m. to 10 p.m., no more than two vehicles at once, all vehicles registered to a resident or immediate family, and major work done inside an enclosed structure. Commercial auto repair is banned outright in residential zones.

Repairing vehicles at a Sunnyvale home outside the 7 a.m. to 10 p.m. window, working on more than two vehicles at once, servicing a non-resident's car, painting a vehicle beyond minor touch-ups, or operating any repair work as a commercial enterprise all violate Section 19.18.050 and are enforceable as zoning code violations by the city's code enforcement division, independent of any noise or hazardous-material nuisance charge under Section 19.42.020.

Compared to other cities, Sunnyvale takes a harder line on auto repair on residential property. The enforcement and penalty structure reflects that.
