Thornton's Business Licensing & Operations: The Rules That Matter

Operating without a license, or continuing to operate after a suspension under Section 42-385, is a separate unlawful act; Section 42-384 makes the conviction of any employee or owner for a felony, city ordinance violation, license-application misrepresentation, or any moral-turpitude offense arising from the business grounds for suspension or revocation of the massage parlor license, on top of any criminal penalty for the underlying offense.

Pawnbrokers

Thornton requires anyone running a pawnshop to hold an annually renewable, nontransferable pawnbroker's license from the city before making a single loan or purchase. Licensees must fingerprint and photograph every customer, hold pledged goods for a mandatory waiting period, and upload every transaction to the police department's LeadsOnline database daily.

Any violation of Article VII is punished under City Code § 1-8(a), and each day a violation continues counts as a separate offense (§ 42-472). A pawnbroker whose license is revoked forfeits any refund of the license fee and cannot obtain the same or a similar license, personally or as a principal in another business, during the suspension or revocation period (§ 42-516(f)-(g)).

This is not one of those rules that cities tend to ignore. Thornton actively enforces its pawnbrokers requirements.

Adult Entertainment

Thornton requires every adult bookstore, cabaret, theater, arcade, motel, novelty shop, escort agency, or nude model studio to hold an annually renewable city license under Article VIII of the code before opening. Applicants must submit a certified survey proving the site sits away from schools, parks, religious institutions, dense residential zoning, and other sexually oriented businesses within 1,000 feet.

Operating without a valid, unsuspended, unrevoked license carries a minimum $250 fine plus the maximum penalty authorized under § 1-8, with each day of operation a separate offense (§ 42-553(a),(e)(1),(e)(3)). Violations involving underage patrons or on-premises sexual contact (§ 42-553(c)-(d)) are punished up to the maximum penalty under § 1-8(b), which allows up to 364 days' incarceration.

Compared to other cities, Thornton takes a harder line on adult entertainment. The enforcement and penalty structure reflects that.
