Why Tracy Has Some of the Strictest Business Licensing & Operations in the State

Tobacco Retail License

Tracy zoning bars tobacco and vape retailers from locating within 600 feet of any school, day care center or youth center, and adds a second 600-foot buffer from residential zones for shops that devote more than 10 percent of floor space to tobacco products.

Locating or continuing to operate a tobacco retailer inside the 600-foot buffers without nonconforming-use protection is a zoning violation of TMC section 10.08.3194, enforced through Tracy's citywide code enforcement scheme in Chapter 1.04 and section 1.16.010, which authorize infraction citations, denial or revocation of related land-use permits, and public nuisance abatement, with each day of noncompliance treated as a separate offense.

Compared to other cities, Tracy takes a harder line on tobacco retail license. The enforcement and penalty structure reflects that.

Adult Entertainment

Tracy confines adult businesses to the Community Shopping Center, Light Industrial and General Highway Commercial zones under Municipal Code Section 10.28.806, and even there bars them within 1,000 feet of any residential zone, school, park, religious institution or another adult business. Operators also need an adult business use permit under Section 10.28.808 before opening, on top of ordinary zoning approval.

Key details: Allowed zones: CS, M-1, GHC only. Buffer distance: 1,000 ft from homes, schools, parks, churches, other adult uses. Permit required: Adult business use permit (§10.28.808). Approving body: Planning Commission, City Council on appeal. Violation penalty: Misdemeanor + permit revocation.

Operating an adult business without a use permit, or violating any of the Section 10.28.818 operating conditions, such as staying open past midnight or admitting a minor, is grounds for the Planning Commission to suspend or revoke the permit under Section 10.28.824 after a noticed hearing, and a revoked permit cannot be reissued to the same permittee for 12 months. Separately, Section 10.28.828 makes any violation of the chapter a misdemeanor under Chapter 1.04 and lets the City Attorney or District Attorney pursue the operation as a public nuisance for abatement, removal and injunction.

This is not one of those rules that cities tend to ignore. Tracy actively enforces its adult entertainment requirements.

Auto Repair on Residential Property

Tracy's home occupation ordinance names vehicle and appliance repair shops among the uses flatly banned from residential properties. Tracy Municipal Code section 10.08.4610(a), part of Article 36 of the zoning code, prohibits "appliance or vehicle repair shops" as a home occupation in every residential district, alongside animal hospitals, beauty parlors and pet grooming, no matter how small the operation or whether the resident applies for a home occupation permit.

Key details: Governing section: Tracy Municipal Code § 10.08.4610(a). Prohibited use: "appliance or vehicle repair shops". Also barred: pet grooming, animal hospitals, beauty/barber shops. First infraction fine: up to $100 (§1.04.030). Repeat violation fine: up to $500 per offense.

Operating a home-based vehicle or appliance repair business in Tracy is treated as an unlawful use of the property, not a permit denial, since section 10.08.4610 leaves nothing for the Community Development Director to approve. A first offense is an infraction carrying a fine up to $100 under Tracy Municipal Code section 1.04.030, rising to $200 for a second violation of the same provision within twelve months and up to $500 for each further violation. Two convictions within a year escalate the offense to a misdemeanor, punishable by a fine up to $1,000, up to six months in jail, or both.

Compared to other cities, Tracy takes a harder line on auto repair on residential property. The enforcement and penalty structure reflects that.

Towing Companies

Tracy Police Department dispatches non-consent tows only to operators on its Chapter 3.44 rotation list. Responding to a police radio call or soliciting tow work without a specific department request is unlawful, approved operators must reach the scene within thirty minutes, and each must carry at least $500,000 in liability coverage and a storage lot within two miles of the city limits.

Key details: Response time: 30 minutes or lose rotation turn. Storage lot: within 2 miles of city limits. Storage fence: 6 ft minimum, barbed wire required. Liability insurance: $500,000/$500,000/$100,000 minimum. Passenger transport coverage: $1,000,000 required.

Unauthorized response to a police tow call or unsolicited solicitation of regulated towing work under §§ 3.44.040-3.44.050 exposes an operator to removal from the rotation list. The Chief of Police may suspend or revoke an operator's rotation status under § 3.44.170 for failing the chapter's requirements, lapsed insurance, an unexplained ten-day service gap, or an unnoticed change of ownership, after seventy-two hours' written notice; a rejected or disciplined operator may appeal to the City Manager under § 3.44.240.

Compared to other cities, Tracy takes a harder line on towing companies. The enforcement and penalty structure reflects that.

Massage Establishments

Operating a massage business in Tracy without a police-issued permit is a misdemeanor under TMC 4.20.150. Chapter 4.20, rewritten by Ordinance No. 1366 in December 2025, requires CAMTC-certified therapists, background checks for non-certified owners, permits that expire every June 30th, and limits massage establishments to 10:00 p.m. to 8:00 a.m. closing hours.

Key details: Permit required: From Tracy Police Department, TMC 4.20.150(a). Therapist credential: Current CAMTC certification required, TMC 4.20.040. Permit term: Expires every June 30th regardless of issue date. Operating hours: Closed 10:00 p.m. to 8:00 a.m.. Maximum penalty: Up to $1,000 fine or 6 months jail.

Section 4.20.100 makes any violation of the massage chapter a misdemeanor punishable by up to six months in county jail, a fine of up to $1,000, or both, on top of enforcement through the City's administrative citation process under Chapter 1.28. The Chief may also suspend or revoke the establishment's permit under Section 4.20.210, and can order immediate cessation of operations within 24 hours if the business is running without a valid permit, license, or a properly certified therapist, under Section 4.20.110.

This is not one of those rules that cities tend to ignore. Tracy actively enforces its massage establishments requirements.
