Massage Establishments

West Palm Beach requires massage businesses to hold both a business tax receipt and a certificate of use before opening. City Code § 22-31 places NAICS 812193 (Masseur/Masseuse) on the short list of service categories covered by the certificate-of-use article, and § 22-32(a) makes it unlawful to conduct that business without first obtaining the certificate from the city.

Conducting a massage business without a certificate of use is prosecuted under § 1-13 of the Code, per § 22-36. The special magistrate can suspend or revoke an issued certificate for up to 12 months under § 22-39(d) after a noticed hearing; no fees are refunded on suspension, revocation, or a resulting closure, and the police department enforces any closure order.

Adult Entertainment

West Palm Beach's zoning code keeps adult entertainment establishments at least 750 feet from any residentially zoned land, from another adult entertainment establishment, and from any preexisting church, school, park, playground, pool, golf course or athletic field under city control.

Locating or operating an adult entertainment establishment outside the 750-foot buffer, or without the required license proof and screened openings, is a zoning violation under § 94-9: a fine of up to $500.00 per offense, with each day of continued violation a separate offense, plus the city may seek a court injunction to stop the illegal use or refer the matter to code enforcement under chapter 26.

This is not one of those rules that cities tend to ignore. West Palm Beach actively enforces its adult entertainment requirements.

Auto Repair on Residential Property

West Palm Beach lets residents keep RVs, boats and oversized trucks at home, but Sec. 94-487 of the zoning code bars major repair work on those vehicles while they sit on residential property. Routine upkeep is fine; engine, transmission or body work is not.

Performing engine, transmission, exhaust, body or chassis repairs on a restricted vehicle (an RV, boat, or oversized truck) while it sits on residential property violates Sec. 94-487(b)(3)c and is enforced as a zoning violation by the planning and zoning administrator. A property owner who disputes an enforcement decision on the location or screening rules must apply to the zoning board of appeals for a waiver rather than simply continuing the repair work.

Towing Companies

West Palm Beach only allows non-consent tows through its own contracted wrecker operator system. Code § 86-9(a) creates a rotation of authorized wreckers selected by competitive procurement to remove wrecked, disabled or abandoned vehicles when the owner is unavailable or doesn't consent, and the city adds a 25 percent administrative fee on top of the county's maximum towing rate under § 86-9(d).

Unauthorized wrecker conduct is enforced under state law as incorporated by § 86-9(f): monitoring police radio to find wrecked vehicles is a noncriminal violation under F.S. § 775.083; soliciting or towing a vehicle before the authorized wrecker arrives is a second-degree misdemeanor under F.S. § 775.082 or § 775.083; and falsely claiming to be part of the city's authorized system at an accident scene is a first-degree misdemeanor. Police may immediately impound an offending wrecker at the unauthorized operator's expense.

Compared to other cities, West Palm Beach takes a harder line on towing companies. The enforcement and penalty structure reflects that.

Tobacco Retail License

Any tobacco shop, vape store or tobacco-products retailer operating in West Palm Beach must hold a city local business tax receipt before opening, issued by the business tax official under City Code § 82-144. The classified annual rate for a Tobacco Store (NAICS 453991) is $57.88 under § 82-163.

Operating without first obtaining the receipt draws a 25 percent penalty of the tax due under § 82-143(b), on top of the tax itself. Unpaid taxes become delinquent after September 30 and accrue a 10 percent penalty for October plus 5 percent for each additional delinquent month, capped at 25 percent of the tax under § 82-143(a). If the tax remains unpaid 150 days after the initial notice, the business is subject to civil action, court costs, attorneys' fees and a penalty up to $250 under § 82-143(c). Separately, § 82-143(d) makes operating in violation of the article punishable by a fine of up to $500.00 a day and/or 60 days in jail for each day the business operates without the receipt.

Secondhand Dealers

West Palm Beach requires every secondhand goods dealer, consignment shop, or precious-metals buyer to hold a local business tax receipt and a certificate of use before buying, trading, or selling used merchandise. Dealers must fingerprint sellers, report every transaction to police within 24 hours, and hold acquired goods untouched for 15 days before resale.

A special magistrate can suspend or revoke a dealer's certificate of use for any violation of Article X, following written notice and a hearing under Chapter 26 (§ 22-417). Employers answer for their employees' violations (§ 22-411(a)). Accepting title to goods instead of physical possession during the 15-day hold is a first-degree misdemeanor under F.S. §§ 775.082 and 775.083 (§ 22-414(b)), independent of any certificate-of-use penalty.
