Antioch's Cannabis Regulations: The Rules That Matter

Buffer Zones

Antioch's cannabis overlay ordinance sets fixed buffers between cannabis retail and any "sensitive use," a defined term covering K-12 schools, licensed day care and youth centers, and city parks. Table B under Antioch Municipal Code § 9-5.3845(E) sets a 600-foot buffer in the CB 1 and CB 3 overlay districts and 200 feet in CB 2, measured property line to property line.

A cannabis business sited inside the buffer, or operating without the City Council use permit and operating agreement § 9-5.3845(B) requires, is an unauthorized commercial cannabis use and can be shut down; operating any cannabis business outside the conditions in § 9-5.3845(A) violates the citywide general penalty, Antioch Municipal Code § 1-2.01, a misdemeanor unless reduced to an infraction, with each day of continued operation a separate offense.

Dispensary Zoning

Antioch has not opted out of commercial cannabis, but it confines every cannabis business to its Cannabis Business (CB) Overlay Zoning Districts and requires a City Council use permit for each one. Antioch Municipal Code § 9-5.3845 bars any other cannabis business or commercial cannabis use anywhere else in the city.

Operating a cannabis business outside a CB Overlay District, or without the City Council use permit and operating agreement, is an unauthorized commercial cannabis use in violation of § 9-5.3845(A) and (B). Like any Municipal Code violation it falls under the general penalty, Antioch Municipal Code § 1-2.01: a misdemeanor unless the City Attorney reduces it to an infraction, with each day of continued unpermitted operation charged as a separate offense and subject to injunction.
