Why Modesto Has Some of the Strictest Cannabis Regulations in the State

Buffer Zones
Modesto bars every commercial cannabis use, from cultivation to dispensary, from locating within 600 feet of a school, licensed child care center or youth center; within 200 feet of a park or library; or within 100 feet of a residential structure, each measured from the nearest property lines. Cannabis is also banned outright inside the Downtown Cannabis Prohibition Overlay regardless of the parcel's zoning.

Section 10-3.712 declares any activity that violates Article 7 a public nuisance, with each day a violation continues charged as a separate offense. The City can pursue administrative enforcement, civil enforcement, or criminal enforcement where state law allows, and the City Council may adopt cannabis-specific fine amounts by resolution; absent one, the citywide infraction fine schedule in Modesto Municipal Code sections 1-6.305 and 1-6.306 applies, and a prevailing enforcement action can recover the City's attorney's fees.
This is not one of those rules that cities tend to ignore. Modesto actively enforces its buffer zones requirements.
Dispensary Zoning
Modesto limits cannabis dispensaries and other commercial cannabis uses to a Commercial Cannabis Permit in the C-2, C-3, and other listed zones, and bans them entirely within 600 feet of a school, 100 feet of a home, or 200 feet of a park or library. The entire downtown core is a no-cannabis overlay regardless of zoning.

Operating a commercial cannabis use, including a dispensary, in a zone not listed for that use type in Table 3.7-1, within the 600-foot school buffer, the 100-foot residential buffer, the 200-foot park/library buffer, or inside the Downtown Cannabis Prohibition Overlay violates § 10-3.703. Operating without both the City Commercial Cannabis Permit and business license required by § 10-3.704(a) is a separate violation subject to permit denial or revocation under § 10-3.705.
