Port St. Lucie's Cannabis Regulations: The Rules That Matter

Buffer Zones

The buffer is calculated property line to property line in a straight line, without regard to any building standing in between.

A Dispensing Facility sited or operated within 500 feet of a covered school violates section 120.03(A)(1) and is subject to the same enforcement path as any other Chapter 120 violation: business tax receipt revocation under section 120.06 and section 111.26, plus code enforcement action and any applicable civil penalty for operating outside the buffer the zoning approval was conditioned on.

Dispensary Zoning

Port St. Lucie allows Medical Marijuana Dispensing Facilities as a permitted use in the General Commercial (CG) and Industrial (IN) zoning districts, and as a special exception in Service Commercial (CS), under the city's zoning code. Chapter 120 then layers on its own permitting, security, and hours-of-operation requirements before a dispensary can open.

Special exception district: Service Commercial (CS), § 158.126(D)(17). Hours: 7:00 a.m. to 9:00 p.m. only. Security plan required: Silent alarm, video at every entrance.

Section 158.999(A) of the zoning code makes locating or operating a Medical Marijuana Dispensing Facility outside the districts and approvals set out in sections 158.124, 158.126, and 158.136 punishable under section 10.99, with each day of the violation a separate offense. Section 120.06 adds that the city can revoke a dispensary's business tax receipt for noncompliance with Chapter 120, under the revocation procedure in section 111.26.
