Portland's Cannabis Regulations: The Rules That Matter

Every city handles cannabis regulations a little differently. In Portland, Maine, there are 2 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Buffer Zones

Portland bars marijuana cultivation, manufacturing, testing, retail, caregiver, and dispensary uses within 500 feet of any pre-existing public, private, or preschool program, and bars cultivation, manufacturing, and testing facilities within 300 feet of any residential zone, both measured lot line to lot line under Land Use Code § 6.4.23(B).

Siting a marijuana cultivation, manufacturing, or testing facility within 300 feet of a residential zone, or any of the six covered marijuana uses within 500 feet of a pre-existing school or public preschool program, violates § 6.4.23(B) and is treated as a zoning violation, blocking site plan and building permit approval until the location is brought into compliance.

Compared to other cities, Portland takes a harder line on buffer zones. The enforcement and penalty structure reflects that.

Dispensary Zoning

Portland caps marijuana retail stores and registered dispensaries at 2,000 square feet of gross floor area, and separately limits marijuana cultivation facilities to under 2,000 square feet of plant canopy in the I-L/I-Lb zones and under 7,000 square feet in the I-M/I-Mb zones, per Land Use Code § 6.4.23(C)-(D).

Exceeding the 2,000-square-foot gross floor area cap for a marijuana retail store or registered dispensary, or exceeding the 2,000- or 7,000-square-foot plant canopy limits for cultivation in the I-L/I-Lb or I-M/I-Mb zones, is a violation of § 6.4.23(C)-(D) subject to the same zoning enforcement as any other use-standard violation, including denial of the building permit or certificate of occupancy needed to operate.
