Cannabis Regulations in Springfield, IL: What Residents Actually Need to Know

Buffer Zones

Springfield zoning bars cannabis cultivation centers, craft growers and processors from locating within 1,000 feet of a pre-existing school, day care or residential zone, and bars any two cannabis business establishments from sitting within 1,500 feet of each other, under Sec. 155.496(a)-(b). Dispensaries follow a separate, church- and park-inclusive buffer in Sec. 155.497.

Locating a cultivation center, craft grower, processor or transporter within the mandatory 1,000-foot (500-foot for transporters/infusers) school, day care or residential buffer, or within 1,500 feet of another cannabis establishment, is grounds for the zoning administrator to deny or revoke the conditional permitted use under Sec. 155.493, treating the violation as a dissolution of use.

Compared to other cities, Springfield takes a harder line on buffer zones. The enforcement and penalty structure reflects that.

Dispensary Zoning

Cannabis businesses in Springfield don't pick their own site. Zoning Code Sec. 155.492 makes every cultivation center, dispensary, craft grower, infuser, processor and transporter a conditional permitted use, city council approval required, confined to the S-3, B-1, B-2, I-1 and I-2 commercial and industrial districts. None is allowed by right.

Operating a cultivation center, dispensary, craft grower or infuser without an approved conditional permitted use, or outside its assigned zoning district, is a zoning code violation subject to the general penalty in Sec. 155.999. A dispensary that opens outside the 6:00 a.m. to 10:00 p.m. window set by Sec. 155.497(g), or that allows public viewing of product or drive-through sales, violates its conditional permit and risks revocation by the city council.

This is not one of those rules that cities tend to ignore. Springfield actively enforces its dispensary zoning requirements.
