Why Tracy Has Some of the Strictest Cannabis Regulations in the State
Every city handles cannabis regulations a little differently. In Tracy, California, there are 2 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.
Dispensary Zoning
Tracy allows cannabis retail only as a conditional use in specific commercial zones, and caps storefront dispensary permits at one per 10,000 residents under Municipal Code sections 10.08.3196 and 6.36.040(b). Dispensaries must sit at least 600 feet from another dispensary, 600 feet from any school, day care, or youth center, and 50 feet from a residential zone.
Key details: Zoning approach: Prohibited citywide except listed commercial zones (Β§10.08.3196(c)). Permit needed: Conditional use permit + City cannabis business permit. Dispensary spacing: 600 ft from another dispensary (Β§10.08.3196(d)(1)). School/youth buffer: 600 ft from schools, day cares, youth centers. Residential buffer: 50 ft from residential zones.
Operating a commercial cannabis use outside a permitted zone, or without both a City cannabis business permit and a conditional use permit, is a misdemeanor and a declared public nuisance under section 10.08.3196(f), with each day of unlawful operation or outdoor cultivation counted as a separate offense. Chapter 6.36 violations separately carry criminal penalties up to a $1,000 fine or six months in county jail under section 6.36.470, plus a civil penalty of up to $1,000 per day under section 6.36.460.
This is not one of those rules that cities tend to ignore. Tracy actively enforces its dispensary zoning requirements.
Buffer Zones
Commercial cannabis businesses in Tracy must sit at least 600 feet from another storefront dispensary and from any school, day care center or youth center, plus at least 50 feet from a residential zoning district, all measured structure to structure under the City's cannabis land-use ordinance.
Key details: Dispensary-to-dispensary buffer: 600 feet minimum. School/day care/youth center buffer: 600 feet minimum. Residential zone buffer: 50 feet minimum. Outdoor cultivation: Prohibited in every zone citywide. Permits required: Cannabis business permit + conditional use permit.
Section 10.08.3196(f) declares any violation of the chapter a public nuisance and a misdemeanor enforceable under Chapter 1.04, with each day a commercial cannabis business operates in violation of the buffers, or each day outdoor cultivation occurs, treated as a separate offense.
This is one of the stricter rules in Tracy's municipal code. If you are unsure whether your situation complies, it is worth checking with the city before proceeding.

If you are a homeowner, renter, or business owner in Tracy, take the time to understand these requirements before they become a problem.
