Surprise's Curfew Laws: The Rules That Matter

Every city handles curfew laws a little differently. In Surprise, Arizona, there are 2 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Park Curfew

Surprise parks close by default from 10:00 p.m. to 6:00 a.m. unless the city manager posts different hours at a specific park, and it is a violation for anyone other than a peace officer or park ranger to be inside after closing. Section 38-21 lets the city manager extend hours for special events and authorizes signage and access-restricting devices at each park.

Simply being in a park after the posted or default 10:00 p.m. to 6:00 a.m. closing is a civil violation carrying a civil fine. Entering or remaining in a park during an emergency closure ordered under subsection (c), however, is a class 1 misdemeanor, and Surprise Municipal Court must order the violator to pay restitution covering the city's actual costs of enforcement in addition to any sentence or fine imposed.

Juvenile Curfew

Surprise bars anyone under 18 from being on a public street, alley or public place between 10:00 p.m. and 5:00 a.m. Sunday through Thursday, and between midnight and 5:00 a.m. on Friday and Saturday, under City Code Sec. 34-106. Parents and guardians who knowingly let a minor violate the curfew face the same class 1 misdemeanor charge as the minor.

An officer may detain the minor solely to notify a responsible adult under subsection (e), separate from any criminal charge.

Compared to other cities, Surprise takes a harder line on juvenile curfew. The enforcement and penalty structure reflects that.
