Thornton's Drone Rules: The Rules That Matter

By CityRuleLookup

Every city handles drone rules a little differently. In Thornton, Colorado, there are 2 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Recreational Drones

Thornton does not ban recreational drone flying, but Section 38-358 bans careless or reckless UAS operation that risks injury or property damage, bars flying to spy on someone with a reasonable expectation of privacy, and prohibits buzzing or hovering within 15 feet of a non-consenting person or launching within 25 feet of bystanders, livestock or wildlife.

Key details: Governing section: Thornton City Code § 38-358. Adopted: Ordinance No. 3521, April 9, 2019. Harassment buffer: 15 feet from a non-consenting person. Launch/land buffer: 25 feet from bystanders, livestock or wildlife. Penalty basis: General municipal penalty, § 1-8(a).

Violating any part of Section 38-358 is punishable under Section 1-8(a) of the Thornton City Code, the chapter's general penalty provision covering municipal ordinance violations. Thornton police officers and code compliance officers investigate complaints, and each unlawful flight, whether it is careless, reckless, a privacy intrusion, a 15-foot buzzing incident, a 25-foot launch/land violation, or interference with an emergency responder, can be charged as its own separate municipal offense in Thornton Municipal Court.

Park Drone Restrictions

Thornton bans launching or landing unmanned aircraft systems in any city park, parkway, open space, trail, or recreational facility unless the location is posted to allow it. The same section separately bars remote-controlled airplanes and other remote-controlled aerial devices unless posted otherwise, under City Code § 46-42.

Key details: Drone launch/landing: Prohibited unless location posted otherwise. Remote-controlled aircraft: Also prohibited unless posted. Governing section: City Code § 46-42(a)(11). Applies to: All city parks, open spaces, trails, facilities. Director authority: Can prohibit more activities by posting.

Anyone who violates the park prohibited-activities article, including the drone launch-and-landing ban, is punished under the general municipal penalty in City Code § 1-8(a) upon conviction (§ 46-27), which authorizes a fine up to the maximum allowed for municipal courts under state law.

Compared to other cities, Thornton takes a harder line on park drone restrictions. The enforcement and penalty structure reflects that.

The Bottom Line

Thornton's drone rules rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Thornton is broadly strict or permissive.
