Environmental Rules in Brentwood, CA: What Residents Actually Need to Know

By CityRuleLookup Editorial Team

If you live in Brentwood or are thinking about moving there, environmental rules are one of those things you probably won't think about until they affect you directly. Brentwood has 4 specific rules on the books covering different aspects of environmental rules, and some of them might surprise you.

Stormwater Management

Brentwood bars any non-stormwater discharge into its storm drain system and any stormwater discharge that violates the city's NPDES permit. Chapter 14.20 backs the ban with inspections, a misdemeanor or infraction charge, and nuisance-abatement authority.

Key details: Non-stormwater discharge: prohibited, § 14.20.060(A). NPDES permit number: CAS083313. Base violation class: misdemeanor or infraction. Continuing violation: each day is a separate offense. Penalty cap authority: Gov. Code §§ 36900, 36901.

Under Section 14.20.110, violating any provision of Chapter 14.20 is a misdemeanor, though the enforcement officer or city attorney can instead charge it as an infraction. Section 14.20.120 caps misdemeanor penalties at the fine and imprisonment limits set in California Government Code Section 36901 and infraction fines at the limits in Government Code Section 36900. Every day a violation continues is a separate offense under Section 14.20.130, and the city can also pursue civil nuisance abatement and cost recovery.

Erosion Control

Brentwood requires a grading permit for most land-disturbing work and mandates erosion and sediment control measures on every graded site. Small disturbances under 10,000 square feet can skip the permit if strict size and slope limits are met.

Key details: Permit trigger: any grading, filling or excavation. No-permit disturbance limit: 10,000 sq ft or less. No-permit soil volume limit: 50 cubic yards or less. Watercourse buffer for exemption: 50 feet minimum. First-violation fine: $100.

Section 15.52.180 lets the city enforce Chapter 15.52 through the administrative citation procedure in Chapter 1.24 or any other code, state, or federal remedy, and can issue verbal warnings, correction notices, citations, or a stop-work order for failing to follow approved construction best management practices. Fines run $100 for a first violation, $250 for a second occurrence of the same violation regardless of subcontractor, and $1,000 for each subsequent violation, with the permit holder responsible for its agents' and subcontractors' compliance.

Flood Elevation Requirements

Brentwood requires new and substantially improved residential structures in flood hazard areas to elevate the lowest floor one foot above base flood elevation in A zones, or two feet above it in every other flood zone.

Key details: A-zone freeboard: 1 foot above base flood elevation. All other zones freeboard: 2 feet above base flood elevation. AO-zone default: 4 feet above highest adjacent grade. Certification required: registered engineer or surveyor. Flood vent opening ratio: 1 sq in per sq ft enclosed.

Construction that fails to meet the elevation or flood-proofing certification requirements of Section 15.07.300 is enforced by the city's floodplain administrator, who reviews the required engineer or surveyor elevation certification before accepting a project as compliant; a structure lacking that certification or built below the required freeboard is treated as noncompliant with the floodplain management chapter, subject to the chapter's general permit and appeal provisions under Sections 15.07.200 and 15.07.230.

Flood Zones

Portions of Brentwood lie within FEMA-designated Special Flood Hazard Areas (SFHAs), particularly along Marsh Creek, Sand Creek, Dry Creek, and Deer Creek corridors. Development in these zones requires a floodplain development permit, elevation certificate, and compliance with the city's floodplain management ordinance.

Key details: Marsh Sand: Marsh, Sand, Dry, and Deer Creek corridors in SFHAs. Permit Required: Floodplain development permit + Elevation Certificate required. Lowest Floor: Lowest floor at/above BFE, plus freeboard. Insurance Required: Flood insurance required for federally-backed mortgages in AE. NFIP Participation: NFIP participation; CRS activities reduce premiums.

The Bottom Line

Brentwood's environmental rules rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Brentwood is broadly strict or permissive.

These rules come from Brentwood's publicly available municipal code. For complete penalty schedules, exemption details, and answers to common questions, see the individual ordinance pages throughout this guide.
