Flood Elevation Requirements

Middleton's Floodplain Zoning Ordinance requires the lowest floor of new and substantially improved residential structures in the floodfringe to sit at or above the flood protection elevation, defined as two feet of freeboard above the Regional Flood Elevation, with fill extending at least 15 feet past the structure.

Failure to obtain a floodplain development permit before building, filling, or altering a structure in a mapped flood hazard area is a violation of Chapter 24, punishable under Section 24.10 by a forfeiture of not more than $50 per day, with each day of continued violation a separate offense, referred to the municipal attorney for prosecution. Every violation is also a public nuisance that the City, the state, or any citizen may enjoin or abate under Wis. Stat. Section 87.30.

Erosion Control

Middleton requires an Erosion Control Plan and land disturbing permit for construction disturbing more than 4,000 square feet, moving over 400 cubic yards, or grading slopes steeper than 12 percent, capping soil loss at 7.5 tons per acre per year under Chapter 28.

Beginning land disturbance without an approved plan, or failing to correct noncompliance within 24 hours of the City Engineer's notice, results in a posted stop work order; continued noncompliance can revoke the permit (Section 28.09(4)-(5)). The City Engineer may then perform remedial work and bill the owner as a special charge. Violators also face forfeiture under Section 30.04 and injunctive relief under Wis. Stat. Section 62.23(8), without first needing a forfeiture conviction.

Stormwater Management

Middleton requires a Storm Water Runoff Control permit for new development that creates 20,000 square feet or more of impervious surface, or redevelopment disturbing 4,000 square feet or more, and mandates an 80 percent sediment-load reduction for new development under Chapter 26.

Key details: Permit trigger: 20,000 sf new impervious / 4,000 sf redevelopment. Sediment reduction: 80% new / 40% redevelopment. Infiltration standard: 90% of predevelopment volume. Review period: 60 calendar days, silence = approval. Financial guarantee: Required over $5,000 practice cost.

Noncompliance found during a required inspection, held at least every 30 days during construction, triggers written notice and a 24-hour deadline to begin corrective action (Section 26.11(3)). Missing that deadline brings a stop work order, permit revocation, and City remedial work billed to the owner as a special charge under Wis. Stat. Section 66.0627. Violators also face a forfeiture under Section 30.04 and injunctive action under Wis. Stat. Section 62.23(8).
