Environmental Rules in Montgomery, AL: What Residents Actually Need to Know

Erosion Control

Montgomery requires a grading permit before any land-disturbing activity begins, whether it's clearing, excavating, or filling. Grading without a permit is a misdemeanor, and first-time violators face a $60.00 fine under Article V of the city code.

Fines run $60.00 for a first offense, $150.00 for a second within 30 days, and judge-set penalties after that under § 12-224.

Flood Zones

Montgomery requires a floodplain development permit before any construction, fill, or substantial improvement in a mapped special flood hazard area, adopted under Ord. No. 4-2026 effective March 5, 2026. New buildings must sit at least two feet above the base flood elevation, and critical facilities four feet above it. Violations are a misdemeanor with fines up to $500.00.

Critical facilities: 4 feet above base flood elevation, sited outside SFHA if feasible. Floodway residential variance: Never granted for new residential structures. Building or filling in the floodplain without a permit, or ignoring the elevation and floodproofing standards, is a misdemeanor under § 5-623: a fine of up to $500.00, up to 30 days in jail, or both, with each additional day of noncompliance charged as a separate offense. A notice of violation can include a stop-work order, and the recipient has ten working days to appeal to the Board of Adjustment.

Flood Elevation Requirements

Montgomery requires new construction and substantial improvements in mapped flood hazard areas to elevate the lowest floor at least two feet above the base flood elevation. The floodplain administrator issues the required development permit, and non-residential buildings may dry-floodproof to the same two-foot freeboard instead of elevating.

Building or substantially improving a structure in a mapped flood hazard area without a floodplain development permit is a violation the floodplain administrator can flag with a stop-work order and notice of violation under Section 5-638. Section 5-623 sets penalties for violating the floodplain article, and noncompliant elevation or floodproofing can also jeopardize a structure's National Flood Insurance Program coverage.

Stormwater Management

Montgomery prohibits discharging anything but storm water into its municipal separate storm sewer system (MS4), including illicit connections like sewage lines tied into storm drains. Industrial and construction sites with an NPDES permit must file a copy with the city engineer, and the city can inspect any regulated premises during business hours. Fines start at $60.00 for a first violation.

Discharging anything but storm water into the MS4, maintaining an illicit connection, or operating without a required NPDES permit and notice of intent is a misdemeanor under §§ 12-205, 12-207, and 12-223. Fines are $60.00 for a first violation and $150.00 for a second within 30 days under § 12-224, with the municipal judge setting the penalty for repeat violations after that.

Vehicle Idling Restrictions

Montgomery bans idling or leaving any motor vehicle running unattended for more than 15 minutes, treating the act as a public nuisance under the city's noise ordinance. The city says the rule targets air pollution, noise and vehicle theft, and violators face the same fine as other noise-code offenses.

Boat Dock Permits

Montgomery, Alabama permits boat docks, slips, piers, wharves and moorages for yachts and pleasure boats only inside the city's Waterfront Recreation (W-R) zoning district, under City Code Appendix C, Article VII, Section 8. Structures there are capped at two stories or 35 feet, lots carry no minimum area, and any waterfront parcel with dedicated street frontage must keep a 20-foot front yard.

Building or using a dock, pier or accessory structure that does not conform to Appendix C, including construction in the W-R district without following the permitted-use and conditional-use rules, is enforced under the zoning ordinance's Article II. Violators are punished under City Code Section 1-6, with each day a violation continues counted as a separate offense, and the administrative official or an affected neighboring property owner may seek an injunction or mandamus to stop or correct the unlawful construction or use.
