Palm Bay's Environmental Rules: The Rules That Matter

By CityRuleLookup Editorial Team

Every city handles environmental rules a little differently. In Palm Bay, Florida, there are 5 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Flood Elevation Requirements

When FEMA's flood maps don't list a base flood elevation for a site, Palm Bay's Floodplain Administrator defaults it to three feet above the highest adjacent grade, unless evidence shows flooding runs deeper than that.

Key details: Default BFE: 3 ft above adjacent grade. Applies when: FIRM has no elevation data. Set by: Floodplain Administrator. Adopted: Ord. 2024-33, 9-19-24.

Development lacking documentation of the lowest floor's elevation or other required flood certifications is presumed a violation until proof of compliance is provided; the Floodplain Administrator can issue stop-work orders.

Flood Zones

Any development wholly or partly inside a Palm Bay flood hazard area needs a floodplain development permit from the Floodplain Administrator first, covering everything from grading and fill to pools and manufactured homes.

Key details: Permit required: Before any development in flood zone. Basis: Brevard County FIS + FEMA FIRM. Permit expires: 180 days if work not started. Administered by: City Floodplain Administrator.

Development performed without an issued permit, in conflict with a permit, or without required elevation documentation is presumed a violation; the Floodplain Administrator can issue stop-work orders and violators face penalties for continuing work after notice.

Erosion Control

Before clearing, grading, or filling an undeveloped lot, Palm Bay requires a certified biologist's threatened-species assessment, stormwater controls, and on-site sediment retention under the city's development code.

Key details: Trigger: Clearing, grading, or filling undeveloped land. Species check: Biologist assessment before any clearing. FWC permit: Required if protected species present. Stabilization: Within 1 week of clearing. Penalty basis: F.S. Chapter 162 code enforcement.

Violations of Part 2's stormwater and erosion requirements are code violations under § 177.030, enforced with penalties consistent with Florida Statutes Chapter 162, plus city-ordered restoration and a lien for unremedied damage.

Stormwater Management

Palm Bay property owners must build and maintain their own stormwater drainage facilities and get Public Works Director approval before altering any non-city stormwater drainage system.

Key details: Responsibility: Owner maintains on-site drainage facilities. Alteration rule: Requires Public Works Director approval. Adopted: Ordinance 2024-42, passed 9-19-24. Source chapter: Ch. 204, Stormwater Management Utility.

Altering non-city stormwater drainage facilities without Public Works Director approval is unlawful under § 204.10; the city can pursue code enforcement action and citations for violations.

Boat Dock Permits

Palm Bay requires a city building permit plus a state submerged-land authorization from DEP, the St. Johns River Water Management District, and the Army Corps of Engineers before building any pier, dock, or boathouse.

Key details: Docks per lot: One dock maximum per lot. Max height: 4 feet above mean high water. Max size: 800 sq ft or 12x length. Channel setback: 25 feet from marked channels.

Building a pier, dock, or boathouse without both the city building permit and the required state or federal submerged-land authorization, or exceeding the size and setback limits, violates § 174.011.

The Bottom Line

Palm Bay's environmental rules rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Palm Bay is broadly strict or permissive.

Keep in mind that Palm Bay can amend these rules at any council meeting. For the most current version of any rule mentioned here, check the specific ordinance page, where we track updates as they happen.
