Pueblo's Environmental Rules: The Rules That Matter

By CityRuleLookup Editorial Team

Every city handles environmental rules a little differently. In Pueblo, Colorado, there are 4 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Stormwater Management

Pueblo requires developers of sites disturbing an acre or more to build permanent stormwater quality best management practices under the City's Stormwater Utility Ordinance.

Key details: Trigger: 1+ acre land disturbance. Requirement: permanent stormwater quality BMPs. Reviewing authority: Stormwater Director / City Engineer. Tied to: certificate of occupancy issuance.

Enforcement runs through a notice of violation, nuisance abatement under Title VII Chapter 1, or a summons and complaint; each day of noncompliance is a separate municipal offense under Section 1-2-1.

Erosion Control

Pueblo requires owners and operators of construction sites disturbing an acre or more to run erosion and sediment control BMPs through final site stabilization.

Key details: Trigger: construction disturbing 1+ acre. Covers: erosion, sediment, and waste. Temporary BMP removal: within 30 days of stabilization. Review: required before construction starts.

Failure to implement or maintain approved BMPs, or any illegal discharge or illicit connection to the storm drainage system, draws a notice of violation, a nuisance abatement action, or a summons and complaint.

Flood Zones

Pueblo requires a Floodplain Development Permit for any construction in FEMA-mapped Special Flood Hazard Areas within city limits.

Key details: Permit required: Floodplain Development Permit. Administered by: Dept. of Stormwater Utility. Basis: FEMA Flood Insurance Study/FIRM. Applies to: Special Flood Hazard Areas, city limits.

Building or altering land in a Special Flood Hazard Area without a permit is a Code violation punished under Pueblo Municipal Code Β§ 1-2-1.

Flood Elevation Requirements

Pueblo requires new and substantially improved buildings in flood zones to sit at least 1 foot above base flood elevation.

Key details: Freeboard required: 1 foot above BFE. Applies to: residential, nonresidential, manufactured homes. Certification by: Colorado PE, architect, or surveyor. Administered by: Floodplain Administrator.

Building below the required elevation without certification is a Code violation punished under Pueblo Municipal Code Β§ 1-2-1; noncompliant structures can affect flood insurance eligibility and cost.

The Bottom Line

Pueblo's environmental rules rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Pueblo is broadly strict or permissive.

Keep in mind that Pueblo can amend these rules at any council meeting. For the most current version of any rule mentioned here, check the specific ordinance page, where we track updates as they happen.
