Schenectady's Environmental Rules: The Rules That Matter

Erosion Control

Schenectady bars starting any land development activity without an approved stormwater pollution prevention plan (SWPPP) covering erosion and sediment control, reviewed by the responsible board or the Stormwater Management Officer; violators face a stop-work order and fines up to $250 per day under Chapter 148, Article I.

Section 148-18D makes a violation of the erosion and sediment control article a misdemeanor, with each day a violation continues counted as a separate offense, punishable by a fine of up to $250 per offense. A violator must also pay to restore the site, and noncompliance that also breaches the Clean Water Act or the state Environmental Conservation Law can add substantial separate criminal, civil or administrative penalties.

Flood Elevation Requirements

New construction and substantial improvements to residential structures in Schenectady's mapped flood hazard zones must have their lowest floor, including any basement, elevated to at least two feet above the base flood elevation. City Code § 158-17 sets this two-foot freeboard standard for Zones A1-A30, AE and AH, going beyond FEMA's minimum at-BFE requirement.

The Building Inspector can withhold the certificate of compliance needed to legally occupy the structure until the elevation is corrected and recertified.

Stormwater Management

Schenectady's municipal separate storm sewer system may carry only stormwater; § 148-24 bars discharging any other material into it, with narrow exemptions like groundwater and firefighting water, and violations enforced by the Stormwater Management Officer carry fines up to $1,000 and up to six months in jail.

Section 148-32B punishes a first violation of the illicit-discharge article with a fine up to $350, up to six months in jail, or both; a second offense within five years raises the fine to $350-$700, and a third or later offense within five years reaches $700-$1,000, with jail still possible up to six months on each. Each week a violation continues counts as a separate offense.

Flood Zones

No construction, filling, or excavation may begin in Schenectady's FEMA-mapped flood hazard area without a floodplain development permit from the Building Inspector, the city's designated local administrator. Applicants pay a $50 fee and may be asked for a deposit of up to $500 to cover the city's review and inspection costs under City Code § 158-12.

A structure built without an approved variance under Article VI is declared noncompliant and reported to FEMA, and the Building Inspector can also issue a stop-work order to halt unauthorized construction immediately.
