Fitchburg's Fence Regulations: The Rules That Matter

Neighbor Fence Rules

Fitchburg, Wisconsin's land division ordinance lets the city require a subdivider whose plat borders farmland or grazing land to build and maintain a partition fence along that boundary. The subdivider, not the adjoining farm owner, bears the cost, and the duty runs with the land through a recorded plat covenant under Dane County's Fitchburg City Code Section 24-9(f).

Failing to comply with a partition-fence covenant is enforced as a breach of the recorded plat condition rather than through a stand-alone fine: Section 24-14(d) bars the city from issuing any building permit for construction on a site created in violation of Chapter 24's requirements, and the common council can withhold final plat approval until the required covenant is recorded on the plat.

Height Limits

In Fitchburg, Wisconsin residential districts, City Code § 22-56(10) caps a perimeter fence, one built within five feet of the lot line, at six feet and keeps it behind the front face of the house. Front-yard fences are shorter still: no more than four feet, and at least half open air space.

A fence over six feet within five feet of the lot line, a front-yard fence over four feet or less than 50 percent open, or one built with barbed wire, razor wire or similar prohibited material violates § 22-56(10) and is enforced under the citywide penalty schedule in § 1-21: forfeitures of $25 to $500 for a first offense and $50 to $1,000 for a second offense within a year, with each day the fence remains a separate violation.

Retaining Walls

Fitchburg's zoning code sets a one-foot minimum setback from the property line for retaining walls built as residential landscape features, and a stricter two-foot setback for taller solid walls, under the accessory-occupancy standards for the R-L Low Density District.

Key details: Retaining wall setback: 1 ft from property line. Tall solid wall setback: 2 ft (walls 3+ ft high, 3+ ft long). Applies in: R-L, R-LM, R-M, R-H districts. Height cap in this section: None specified. Penalty: $100/day forfeiture.

A retaining wall built inside the required one-foot setback is a Chapter 22 zoning violation. Under § 22-648(d)(2), the zoning administrator can demand the wall be relocated or removed, and noncompliance carries a forfeiture of $100.00 per day. The city attorney may also seek an injunction to force removal. A property owner who needs relief from the setback can apply to the zoning board of appeals for a variance under § 22-644, which requires showing that literal enforcement creates an unnecessary hardship tied to the specific lot.
