Victorville's Fence Regulations: The Rules That Matter

Fence Permit Requirements

Victorville exempts only short fences from a building permit: walls and fences up to three feet tall in rear or side yards, or eighteen inches in front yards, need no permit under the locally amended California Building and Residential Codes. Retaining Walls

Victorville only exempts short retaining walls from a permit: up to thirty inches measured from footing to top in rear or side yards, or eighteen inches from grade in front yards, unless the wall holds back a surcharge or impounds Class I, II or IIA liquids, which always needs a permit regardless of height.

An unpermitted retaining wall above the height threshold, or one supporting a surcharge or liquid load without a permit, is subject to Code Enforcement citation and can be required to be exposed for structural inspection or removed if it fails engineering review. Because retaining wall failures create slope and drainage hazards, the City treats these as active safety violations, not just paperwork lapses.

Material Restrictions

Victorville's Development Code bans razor wire and barbed wire on any residential fence and prohibits chain link on new multi-family developments and in the front or street-side yard of single-family lots under a half-acre. Sec. 16-3.08.030 also requires six-foot decorative masonry walls around new subdivisions and limits most rear and side yard fences to 7 feet.

Installing a prohibited fence material or exceeding the height limit is enforced through the citywide administrative citation process in Sec. 1.05.050-1.05.110: an enforcement officer issues a notice of violation, then a citation if it isn't corrected, with the civil penalty due within 30 days and a 100% late fee for nonpayment. Sec. 1.04.010 alternatively treats an uncorrected violation as a public nuisance, with each day of noncompliance a separate offense.

This is not one of those rules that cities tend to ignore. Victorville actively enforces its material restrictions requirements.

Height Limits

Victorville caps fences and walls at eight feet citywide under Sec. 16-3.24.080, measured from the lowest ground level abutting the wall, unless a stepped design is used or the Planning Commission approves otherwise. Table 8-2 layers tighter district rules on top of that ceiling: most front yards allow no fence, while rear and side yards are capped at seven feet, six feet in R-2 through R-4.

A fence built taller than the applicable district limit in Table 8-2, or above the citywide eight-foot ceiling in Sec. 16-3.24.080 without a step design or Planning Commission approval, is a zoning violation the City can require torn down or lowered to the legal height; the Zoning Administrator's security-based exception under footnote (3) must be documented and approved before, not after, construction.
