Public Conduct in Thornton, CO: What Residents Actually Need to Know

Public Alcohol Use

Thornton Code Section 42-27 makes it unlawful to possess an open container of or consume any alcoholic or fermented malt beverage in public, unless on premises licensed under Colorado's Alcohol Law. "Public" reaches streets, parks, parking lots, and even private property the public may enter, and open containers are also barred from a vehicle's passenger area.

Section 42-27 does not set its own fine schedule, so under Section 1-8(C), which states that violations of municipal ordinances are punishable under subsection (b) absent a contrary provision, an open-container or public-consumption violation carries a fine of up to $1,000.00, up to one year in jail, or both, with jail excluded for anyone under 18 except for contempt of court.

Outdoor Smoking Restrictions

Thornton does not ban smoking outdoors citywide; Article XI's indoor smoking rules exempt the outdoor area of any business. Instead, Section 46-42(a)(9) bars smoking within 25 feet of any playground or sand or beach volleyball court in a city park, parkway, open space, trail, or recreational facility.

Section 46-27 makes any violation of the parks and recreation article, including the smoking buffer in Section 46-42(a)(9), punishable under Section 1-8(a): a fine up to $1,000.00 per offense, with no incarceration component. Park rangers and code compliance officers can issue a citation on the spot, and repeated violations at the same location can support a request to bar the individual from the facility.

Thornton is more permissive than most cities when it comes to outdoor smoking restrictions. That said, there are still limits.

Public Marijuana Use

Thornton Municipal Code Section 38-297 makes it unlawful to openly and publicly display, consume, or use two ounces or less of marijuana anywhere in the city, or to use any amount in a way that endangers others. Adults 21 and older may keep up to two ounces privately, but anyone under 21 cannot possess, display, or use any amount of marijuana anywhere in the city.

Violations of subsections (a), (b), and (d), covering public display, consumption or use of up to two ounces and unlicensed sale or transfer, are penalized under Section 1-8(b): a fine up to $1,000.00, jail up to one year, or both. Violations of subsection (c), possession by anyone under 21, carry the same Section 1-8(b) range. A person under 18 at the time of the offense is exempt from jail unless the violation is contempt of court or defiance of a lawful court order.

This is not one of those rules that cities tend to ignore. Thornton actively enforces its public marijuana use requirements.

Public Urination

Thornton makes it a crime to urinate or defecate on any public street, alley, or highway, in a public parking lot, or in any area open to public view that isn't designated for that purpose. Section 38-271 has stood in the City Code since 1986 and is enforced by Thornton police as a municipal offense.

A person convicted of urinating or defecating in public under Section 38-271 is punished as provided in Section 1-8(a) of the City Code: a fine up to the maximum amount authorized by state law for municipal courts. The general penalty section bars jail time for anyone under 18 except for contempt or violating a court order.

Skateboarding Rules

Thornton lets skateboards and electric skateboards use parks and trails, but riders must obey traffic laws, yield to pedestrians, and stay off playgrounds, tennis and game courts, and pavilions. Violations fall under Code of Ordinances Section 46-44(d).

Skateboarding in a prohibited area, such as a playground, tennis or game court, pavilion, or synthetic turf field, or riding without yielding to pedestrians or uphill trail users, violates Section 46-44(d) or 46-45(f). Park and police staff can order a rider to stop or leave under the director's or police chief's authority in Sections 46-43 and 46-45(e); repeat or willful violations are citable municipal offenses.

Aggressive Panhandling

Thornton bars anyone from soliciting money, employment, contributions, or sales from occupants of vehicles traveling on a city street or highway when doing so puts the solicitor in the travel lanes, on a median, or blocking traffic flow. Section 38-207(c) targets panhandling and sales pitches directed at drivers stopped in traffic.

Key details: Prohibited act: Soliciting drivers from a street median. Also banned: Entering traveled lanes to solicit. Interstate rule: No vehicle-occupant contact on interstate (subsec. d). Exempt: Police officers, permitted construction workers. Penalty: Fine under Sec. 1-8(a).

A conviction under Section 38-207(c) or (d) is punished as a municipal offense under Section 1-8(a), a fine capped at the maximum amount state law authorizes for municipal courts. Each vehicle approached in violation of the median or traveled-lane restrictions can be charged as a separate offense, and juvenile involvement triggers a mandatory report to Adams County Social Services.
