Pawtucket's Rental Property Rules: The Rules That Matter

By CityRuleLookup Editorial Team

Every city handles rental property rules a little differently. In Pawtucket, Rhode Island, there are 2 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Repairs & Habitability

Pawtucket's Housing Standards chapter sets hard numeric minimums for rented dwellings: heat capable of 68°F at three feet off the floor when it is 0°F outside, hot water of at least 120°F, working plumbing fixtures, and smoke detectors near every sleeping room.

Key details: Minimum heat: 68°F at 3 ft, when outside is 0°F. Minimum hot water temp: 120°F at every fixture. Smoke detectors: Within 15 ft of every sleeping room. Max fine: $500 per offense, per day. Enforced by: Division of Zoning and Code Enforcement.

Anyone who violates any Chapter 247 provision or an adopted rule is fined up to $500 for each offense, with each day of noncompliance counted as a separate violation (§ 247-18). The City Solicitor can also pursue an injunction or abatement action on the Director's complaint, and these remedies are cumulative, not exclusive, so a landlord can face both fines and a court order to fix the same defect.

Rental Registration

Pawtucket requires "absentee landlords," owners who don't live at their rental dwelling, to register with the Office of Zoning and Code Enforcement: name, contact number, an emergency phone line, and the mortgage holder's and insurer's names and addresses. Out-of-state owners must also designate a local agent for service.

Key details: Who must register: Absentee (non-resident) landlords only. Filed with: Office of Zoning and Code Enforcement. Registration deadline: 30 days from city notice postmark. First offense fine: Up to $100. Repeat offense fine: Up to $500.

Failing to provide the required information is prima facie evidence of a violation, heard in Pawtucket's Police Court: a first offense carries a fine of up to $100, and each later offense up to $500 (§ 325-5). Any fine unpaid 30 days after the citation becomes a lien on the rental property itself (§ 325-6).

The Bottom Line

Pawtucket's rental property rules rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Pawtucket is broadly strict or permissive.
