Encroachment Permits

Street artists selling their own work and table-and-chair petitioners engaged in protected speech are exempt outside declared festivals.

Both fines accrue daily for as long as the violation continues.

Obstruction Rules

Portland requires a revocable street and sidewalk occupancy permit before anyone places, suspends or leaves an object, tables, chairs, barricades, portable signs, on a street, way or sidewalk under Sec. 25-26. Business owners may skip the permit only for benches or flower pots kept directly in front of their storefront, provided four feet of clear sidewalk remains for pedestrians.

The code does not print a stand-alone Sec. 25-26 fine; enforcement runs through the permit fee schedule in Sec. 25-27 and the city's general Chapter 25 remedies for unpermitted encroachments on the public way.

Sidewalk Repair

Portland's public works authority, not the abutting property owner, repairs and maintains sidewalks and curbing that the city built or that were constructed under Chapter 25 of the city code. The city covers the cost itself rather than billing the adjacent landowner for upkeep.

Owners petitioning for construction or reconstruction under §§ 25-97(b)/25-98(b) instead face a cost assessment collected as a property lien in the manner used for sewer assessments, capped at 200 feet of frontage per unimproved lot under § 25-103.

Portland is more permissive than most cities when it comes to sidewalk repair. That said, there are still limits.
