Elizabeth's Sign Regulations: The Rules That Matter

Garage Sale Signs

Elizabeth allows garage-sale signs only on the day of the sale during permitted hours, on the premises covered by the permit, and requires every sign, whether on the property or posted on street poles, to come down immediately once the sale ends.

Leaving a garage-sale sign up overnight, posting it before the sale day, or failing to pull it from the yard, sidewalk, or a street pole immediately after the 5:00 p.m. close violates Section 5.44.020(B)(6) and (B)(8), and the police department and central license bureau enforce the removal requirement alongside the rest of Chapter 5.44's permit terms.

Freeway-Facing Signs

City Code Schedule III, Item O, referenced by Section 17.36.070, permits billboards in any district only within 300 feet of a state or federal highway route or passenger rail facility. Billboards over 300 square feet need planning board approval, must sit at least 2,000 feet apart, and require an annual license fee of 80 cents per square foot.

Key details: Highway proximity rule: On or within 300 ft of a highway/rail line. Minimum spacing: 2,000 feet between billboards. Residential buffer: More than 500 feet from residential use. Annual license fee: $0.80/sq ft, $240 minimum. Governing section: City Code § 17.36.070, Schedule III(O).

Erecting a billboard without the required conditional-use approval, spacing, or square-footage license is a general code violation under Section 1.12.010: a fine of $100 to $2,000, up to 90 days in county jail, or community service, with each day the sign remains unlicensed a separate offense. The planning board can deny or condition approval on the siting plan required by Schedule III, Item O, before construction begins.

This is not one of those rules that cities tend to ignore. Elizabeth actively enforces its freeway-facing signs requirements.

Window Signs

Elizabeth commercial display windows may carry the store's name, description or logo inscribed on the glass, but that lettering cannot cover more than 25 percent of the total window area under City Code Section 17.48.060(B)(1)(b). Separately, Section 17.48.090(J) bars affixing any temporary sign to display-window or door glass, and second-floor businesses are limited to one window sign.

A city official who finds window lettering exceeding 25 percent of the glass, or a prohibited temporary sign affixed to the glass under Section 17.48.090(J), can direct removal under Section 17.48.030(A)(5); noncompliance past twenty days draws a $100.00-per-day fine against the property owner and business occupant, plus city removal at the owner's expense. Section 17.48.110 additionally blocks future sign permits for anyone who ignores a lawful removal order.
