Islip's Sign Regulations: The Rules That Matter

Every city handles sign regulations a little differently. In Islip, New York, there are 3 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Digital Billboards

Islip's sign ordinance bans commercial billboards outright, any sign rented to advertise a product or business other than the one on the property where it stands, and separately prohibits flashing, revolving or animated signs of any kind, digital or otherwise, except signs that display only time and temperature.

The Building Inspector, and within the IMUPDD the Commissioner of Planning and Development, enforce the sign article; any sign requiring a permit but lacking one is independently prohibited under § 68-396L. A prohibited billboard or unauthorized animated/digital display must be removed, and maintaining a prohibited sign is treated as a continuing violation subject to the Town's standard zoning penalty and removal process.

This is not one of those rules that cities tend to ignore. Islip actively enforces its digital billboards requirements.

Window Signs

Within the Bayport Overlay District along Montauk Highway, Code of the Town of Islip § 68-759C caps window signs at no more than 25% of the total window area, layered on top of the townwide Sign Ordinance in Article XXIX that Bayport businesses must otherwise follow.

Key details: Window sign cap: No more than 25% of total window area. Applies in: Bayport Overlay District, Montauk Highway corridor only. Wall sign cap: 75% of storefront width, letters up to 36 in. Multitenant review: Plan needs Planning Division approval. Penalty: Up to $2,000 fine or 15 days, § 68-421.

Because Bayport's signage standards are part of Chapter 68, Zoning, violations fall under the general zoning penalty in § 68-421: a fine up to $2,000, imprisonment up to 15 days, or both, with each day of continued noncompliance a separate offense, and authority for the Commissioner of Planning and Development to issue a stop-work order.

Holiday Displays

The Town of Islip's exterior lighting ordinance exempts holiday lighting from its glare, shielding and cutoff standards, but only between October 15 and January 15 of the following year. Outside that window, decorative string lights, illuminated menorahs, nativity scenes and yard displays must meet the same full-cutoff and light-trespass rules as any other fixture.

Key details: Exempt window: October 15 to January 15. Covered items: string lights, menorahs, nativity scenes, candles. Governing article: Zoning Ch. 68, Art. LII, Exterior Lighting. After Jan. 15: must meet standard cutoff/glare rules. Enforcement trigger: glare onto a public roadway.

Islip's Code Enforcement Bureau and municipal law enforcement administer Article LII. Lighting that continues to operate outside the October 15–January 15 window loses its exemption and becomes subject to the article's shielding and lumen limits; if it is found to contribute to disabling or distracting glare on a public roadway it may be ordered changed or removed at any time under § 68-684B(3). Non-compliant fixtures found after that can be cited under the Town's general zoning violation and penalty provisions.

If you are coming from a city with tighter rules, you will find Islip gives residents more flexibility on holiday displays.
