Killeen's Sign Regulations: The Rules That Matter

Every city handles sign regulations a little differently. In Killeen, Texas, there are 5 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Digital Billboards

Off-premises digital billboards in Killeen are "changeable electronic variable message signs" (CEVMS) under Sec. 31-502, and Sec. 31-507(B)(11) caps their brightness at 7,000 NITS in full color, requires a factory pre-set light limit certified by the manufacturer, and mandates a dimmer and photocell on every sign so it dims automatically after dark.

Operating a CEVMS above the NITS ceiling, without manufacturer certification, or without a working dimmer and photocell is a sign code violation, an offense classified under Sec. 1-8 with a fine of up to $2,000 for each day the excess intensity or missing equipment continues. The building official can require immediate correction of a sign whose brightness impairs driver vision, and an unregistered or noncompliant CEVMS can have its registration denied or revoked.

Compared to other cities, Killeen takes a harder line on digital billboards. The enforcement and penalty structure reflects that.

Window Signs

Killeen treats a window sign as a wall sign under Sec. 31-502: any sign painted on, affixed to, or placed within 24 inches of the interior side of an exterior window or glass surface counts toward the same 20-percent wall-area cap that Sec. 31-506 sets for all wall signage on a building.

A window sign that pushes total wall signage over the 20-percent cap, or over the 672-square-foot ceiling, is a sign code violation subject to Sec. 1-8's zoning penalty of up to $2,000 for each day the excess signage remains posted. The building official can order excess signage removed or reduced before issuing or renewing a certificate of occupancy for the tenant space.

Political Signs

Killeen lets election signs go up without a permit under Sec. 31-503(10)-(11): general campaign signs up to 36 square feet and 8 feet tall may go up 90 days before and stay 10 days after any federal, state or local election on private property with the owner's consent, while a separate polling-place rule caps signs at 6 square feet within 100 feet of a voting entrance.

Key details: Posting window: 90 days before, 10 days after election. Max size (general): 36 sq ft, 8 ft tall. Polling-place max size: 6 sq ft, 3 ft tall, 1 lb. Polling-place buffer: 100 ft from voter entrance. Consent required: Private property owner's consent.

Erecting an off-cycle, oversized, illuminated or right-of-way election sign outside these exemptions makes it an illegal sign under Sec. 31-505, subject to removal and to the general zoning penalty in Sec. 1-8 of up to $2,000 per day of continuing violation. A sign placed in the visibility triangle or public right-of-way may be declared a public nuisance and abated by the city regardless of its election-sign status.

Holiday Displays

Killeen's outdoor lighting ordinance bans light trespass and uplighting citywide and caps fixture height for every commercial, multifamily and residential property. Section 31-897(b)(3) carves out temporary lighting for holiday decorations, along with civic events and construction projects, from every one of those requirements. The single condition attached to the exemption: the display cannot cause light trespass onto a neighbor's property or create a driving hazard.

Key details: Governing sections: Sec. 31-896 to 31-899, adopted May 14, 2024. Citywide default: Uplighting and light trespass banned on all property. Holiday exemption: Sec. 31-897(b)(3): temporary holiday, civic, construction lighting. Exemption condition: No light trespass or driving hazard allowed. Max fine: $2,000 under general zoning penalty, Sec. 1-8(c).

There is no separate fine schedule for the lighting division, so a holiday display that trespasses light onto a neighbor or blinds drivers falls under Killeen's general penalty, section 1-8: since Chapter 31 is the zoning code, a conviction carries a fine up to $2,000, versus $500 for most other code violations. Each day the trespass continues counts as a separate offense. Code enforcement officers can issue citations directly, and the city can also seek injunctive relief to force the fixture down.

The rules around holiday displays in Killeen lean permissive, but that does not mean anything goes.

Garage Sale Signs

Killeen allows exactly one sign for a garage sale, and it cannot exceed two square feet, posted only on the property where the sale is happening. Any sign anywhere else, a street corner, a utility pole, a median, is banned outright under City Code Sec. 15-74, part of the same article that licenses the sale itself.

Key details: Signs allowed: 1 per sale. Max size: 2 square feet. Location: On the sale property only. Off-site signs: Prohibited entirely. Penalty: Up to $500, Sec. 1-8.

A second sign, an oversized sign, or any sign posted off the sale property is a violation of Article III enforced under the citywide general penalty in Sec. 1-8: a fine of up to $500, with continuing noncompliance charged as a separate offense for each day it persists. Code enforcement can order the sign removed immediately and, if the underlying sale itself is unpermitted, can issue a simultaneous cease-and-desist under Sec. 15-76.

The Bottom Line

Compared to many U.S. cities, Killeen gives residents more room on sign regulations. 2 of the 5 rules here are rated permissive. But permissive does not mean unregulated. There are still requirements, and the city does enforce them when violations are reported.
