Abilene's Solar Energy: The Rules That Matter

By CityRuleLookup

Every city handles solar energy a little differently. In Abilene, Texas, there are 2 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Panel Permits

Abilene requires building permits for solar panel installations. Permit processes vary but most jurisdictions have streamlined solar permitting. Roof-mounted systems must meet structural and electrical code requirements.

If you are coming from a city with tighter rules, you will find Abilene gives residents more flexibility on panel permits.

HOA Restrictions

Texas Property Code Section 202.010 voids any HOA covenant that prohibits or restricts installing a solar energy device on a home in an Abilene subdivision. Property owners' associations can still regulate placement, roof-mounted panel color and slope, and require prior architectural approval, but they cannot use a blanket ban to keep panels off a roof.

Key details: Governing statute: Tex. Prop. Code ยง 202.010. Void covenants: Any HOA ban on solar devices is void. Panel color rule: Frame/bracket/wiring must be silver, bronze, or black. Fenced-yard limit: Panel cannot exceed the fence line. Small-development exception: Declarant may restrict panels under 51 units.

A covenant provision that violates Section 202.010 is void under subsection (c), so an Abilene association cannot enforce it against a homeowner no matter what the recorded declaration says. Under the companion enforcement statute, Property Code Section 202.004(c), a court can assess civil damages of up to $200 per day of violation of a restrictive covenant, and a homeowner denied approval in violation of subsection (e) can sue for a declaratory judgment ordering the board to permit the installation.

Compared to other cities, Abilene takes a harder line on hoa restrictions. The enforcement and penalty structure reflects that.

The Bottom Line

Abilene's solar energy rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Abilene is broadly strict or permissive.
