Carlsbad's Solar Energy: The Rules That Matter

Expedited Solar Permitting

Carlsbad's building official must run an expedited, administrative, nondiscretionary review for small residential rooftop solar systems under 10 kW AC (30 kW thermal). Carlsbad is more permissive than most cities when it comes to expedited solar permitting. That said, there are still limits.

HOA Restrictions

California Civil Code § 714 makes any homeowners association rule that effectively prohibits or restricts a solar energy system void and unenforceable, so a Carlsbad HOA cannot refuse outright. It may impose reasonable restrictions only, and a condition that adds more than $1,000 in cost or costs more than 10% of the system's efficiency is not reasonable.

This is not one of those rules that cities tend to ignore. Carlsbad actively enforces its hoa restrictions requirements.

Panel Permits

Carlsbad requires an eligibility checklist and lets homeowners submit rooftop solar permit applications electronically, by mail, or in person to the building division, with an electronic signature accepted in place of a wet one under Section 18.25.050.
