Sidewalk Dining & Cafés

In the Town of Colonie's Commercial Office Residential (COR) district, a restaurant's outdoor dining area must leave at least five feet of clear sidewalk, or half the sidewalk's width if that is more, and cannot block the public right-of-way. Town Code § 190-40B(6) also caps enclosure sides, furnishings and cleanup requirements for the cafe area.

Failing to keep the dining area and adjacent right-of-way free of litter, debris or any substance that could damage the sidewalk or injure a pedestrian is a violation of the conditions of approval under § 190-40B(6)(e). If the five-foot (or 50%) sidewalk clearance is not maintained, the outdoor seating itself is not permitted to operate under § 190-40B(6)(c), and furnishings left outdoors after closing or attached to public property also breach § 190-40B(6)(d).

Park Event Permits

Anyone holding a gathering, ceremony, speech, parade or setting up a tent or platform in a Colonie Town park needs a special permit from the Parks and Recreation Department under §§ 137-25(B) and 137-29(A)(7); § 137-6 sets the fee by Town Board schedule and holds the group's representative accountable.
