Trash & Recycling in Islip, NY

If you live in Islip or are thinking about moving there, trash & recycling are one of those things you probably won't think about until they affect you directly. Islip has 7 specific rules on the books covering different aspects of trash & recycling, and some of them might surprise you.

Illegal Dumping

Town Code makes it unlawful to accumulate more than one cubic yard of solid waste or recyclables on any parcel, street, lot, park or open space, public or private, unless the site is licensed for that purpose. Violators face an unclassified misdemeanor with fines from $1,000 to $10,000 or up to a year in jail, plus mandatory cleanup.

A dumping violation is an unclassified misdemeanor under § 21-8(C), carrying a fine of not less than $1,000 and not more than $10,000, up to one year in jail, or both. The responsible party, often the record owner even where a tenant or contractor caused the dumping, must also remove the waste and restore the site; the Town can pursue that separately from the criminal charge and add remedies under §§ 21-15 and 21-17 for continuing violations.

This is not one of those rules that cities tend to ignore. Islip actively enforces its illegal dumping requirements.

Dumpster Rules

In the Town of Islip's Business District (BD), Code § 68-270(D) requires that dumpsters, along with rooftop equipment, structured parking and loading areas, be screened consistent with the building's architecture, or with fencing and/or landscaping for ground-level features. The Town applies the identical screening command in its Industrial Corridor District under § 68-476(B), governing where commercial refuse containers may sit and how visible they can be.

Screening violations are Town Code violations, not stand-alone criminal offenses. Under § 69-2, the Bureau of Administrative Adjudication, created 7-18-2023 by L.L. No. 4-2023, "is authorized to render decisions and orders and to impose monetary penalties as provided by law" for Town Code violations, and such penalties "shall be civil in nature"; the Bureau cannot impose imprisonment. The Town Attorney separately retains authority to pursue criminal penalties or civil relief for Chapter 68 violations in a court of competent jurisdiction.

Collection Schedule

In the Town of Islip, the Environmental Control Commissioner designates residential garbage and recycling collection days by Special Garbage and Refuse District. Receptacles may go to the curb no earlier than 4:00 p.m. the day before collection and must be brought back by 10:00 a.m. the day after.

Setting cans out before 4:00 p.m. the prior day, leaving them at the curb past 10:00 a.m. the day after pickup, or using overweight pails violates § 21-4 and carries a $100-to-$750 fine and up to 15 days' imprisonment.

Mandatory Organics Recycling

The Town of Islip makes residents separate recyclables, but its designated-recyclable list covers paper, cardboard, metal, glass, plastic, textiles and electronic waste, not food scraps. No town law requires separating organic food waste for composting.

There is no food-scrap penalty. Placing designated recyclables in the trash, or setting grass clippings out with regular Town collection, violates § 21-4 and carries a fine of $100 to $750, up to 15 days' jail, or both.

Pickup Rules & Schedules

Town Code § 21-11 bars commercial haulers from collecting solid waste and recyclables in Islip before 5 a.m. or after 8 p.m. Monday through Saturday, and restricts Sunday and federal-holiday pickups to 6 a.m.–5 p.m. A violation carries a $500-to-$2,000 fine or up to 15 days in jail.

An out-of-hours collection run violates § 21-11 and, per Subsection A, is punishable by a fine of not less than $500 and no more than $2,000, up to 15 days' imprisonment, or both, and may trigger the additional remedies available under § 21-15.

Holiday Pickup Schedule

The Town of Islip cancels curbside collection on holidays marked on its 2026 WRAP calendar, and service does not make up the day. The grid marks Thursday, November 26 and Friday, December 25, 2026. Pickup resumes on your next regularly scheduled collection day, and everything must be at the curb before 6:00 A.M.

The holiday cancellation is a service rule, not a penalty provision. The enforcement risk comes from the set-out rules around it. Under § 21-4D, it is unlawful to place recyclables designated by the Commissioner out with solid waste, and unlawful to place grass clippings, hazardous materials or medical waste out for Town collection at any time. Waste left at the curb after a cancelled holiday still has to comply with those rules when it is set out again.

Yard Waste Collection

The Town of Islip's Fall Unlimited Yard Waste program for residences runs October 26 to December 19 on the 2026 calendar, and leaves must be bagged or pailed and weigh under 50 lbs. During the program, leaves are collected curbside separately from the garbage. Grass clippings are never collected, and § 21-4D(2) makes setting them out unlawful.

Placing grass clippings out for collection at any time breaks § 21-4D(2). Any violation of § 21-4 is a violation of law punishable under § 21-4F(1) by a fine of no less than $100 and no more than $750, a term of imprisonment not to exceed 15 days, or both. Obstructing a Special Garbage and Refuse District service vehicle is penalized separately under § 21-4F(2) at no less than $250 and no greater than $1,000.

The Bottom Line

Compared to many U.S. cities, Islip gives residents more room on trash & recycling. 2 of the 7 rules here are rated permissive. But permissive does not mean unregulated. There are still requirements, and the city does enforce them when violations are reported.
