Lafayette's Trash & Recycling: The Rules That Matter

Every city handles trash & recycling a little differently. In Lafayette, Louisiana, there are 9 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Holiday Pickup Schedule

Lafayette City-Parish Government's residential trash contractor may suspend curbside collection on eight recognized holidays, but the contract requires at least one collection per Residential Unit every week regardless. Expect a shifted, not skipped, pickup day around Mardi Gras, Thanksgiving and other listed holidays.

A missed pickup is handled as a complaint under Section 4.05: residents report it to the contractor, who must investigate promptly and, if the missed collection is verified, collect the uncollected material within 24 hours of the complaint. The contractor also files a monthly report to the LCG Director of Public Works logging every complaint, its legitimacy determination, and the resolution date. Section 4.06 backs this with a financial penalty on the contractor, not the resident: $25 per un-serviced Residential Unit per day, beginning the second day, deducted from LCG's monthly payment to the contractor.

Lafayette is more permissive than most cities when it comes to holiday pickup schedule. That said, there are still limits.

Illegal Dumping

Lafayette City-Parish Consolidated Government bans dumping solid waste, bulky waste, recyclables, or any unsightly or offensive material on private yards, streets, sidewalks, alleys, drains, or other public places under City Code § 34-80. A related ban on operating an 'open dump' anywhere in the jurisdiction appears at § 74-85, both enforced through the Code's general penalty.

A violation of § 74-80 or § 74-85 is punishable under the Code's general penalty, § 1-9: a fine not exceeding $500.00, imprisonment not exceeding six months, or both, with each day a continuing violation persists treated as a separate offense. The public works director may also enter the property, remove the dumped material, and bill the owner or occupant for the cost of cleanup and disposal.

This is not one of those rules that cities tend to ignore. Lafayette actively enforces its illegal dumping requirements.

Yard Waste Collection

Lafayette defines a yard waste container as a 20-to-35-gallon receptacle whose contents can't exceed 50 pounds, and requires it set out within three feet of the street. Miss the 24-hour return window and public works can charge $25 per container, capped at $150 a year, only after one written notice. Collection runs 4 a.m. to 8 p.m.

Leaving a yard waste container out past the 24-hour return window draws a $25 per-container fee after one written warning, capped at $150 per address annually under Sec. 74-32(a)(3). Setting out yard waste not covered by an LCG contract, or letting anyone but an LCG-authorized contractor collect it, violates Secs. 74-37 and 74-42. Absent a specific fine for those sections, they carry Lafayette's general penalty: up to $500 and six months in jail under Sec. 1-9(c), with each continuing day a separate offense.

Bin Placement Rules

Lafayette requires solid waste, yard waste and recycling containers to sit within three feet of the curb for collection and be pulled back within 24 hours after the truck empties them, or the owner faces per-container fees.

A container left past the 24-hour set-back window draws a $25.00 fee per container after a first written notice, capped at $150.00 per calendar year; unpaid fees are recorded as a lien in the Lafayette Parish mortgage office and added to the owner's tax bill. Damaged or non-conforming containers get a 7-day cure period before public works may collect and dispose of them under Sec. 74-32(b).

Dumpster Rules

Lafayette requires every commercial establishment to use a solid waste container of at least one cubic yard with closing lids, kept on-site and off public streets and rights-of-way. Public works inspects containers, gives 48 hours to fix violations, and can force removal of emergency-condition containers; new commercial construction can't get its occupancy permit without a hired collection contractor already lined up.

Placing a container on a street or right-of-way, storing waste on the ground outside it, or ignoring a 48-hour cleanup notice under Sec. 74-52 puts the owner in violation of Chapter 74. Failing to prove a hired contractor before occupancy under Sec. 74-53 blocks the permit outright. Because this division carries no stand-alone fine schedule, enforcement falls to Lafayette's general penalty, Sec. 1-9(c): a fine up to $500, imprisonment up to six months, or both, with each continuing day a separate offense.

Collection Schedule

Lafayette City-Parish requires every residential unit in the service area to carry solid waste, yard waste and white goods collection through an LCG-authorized contractor, and residential collection may only run between 4:00 a.m. and 8:00 p.m.

Failure to maintain mandatory solid waste service triggers a notice of violation referred to the city-parish attorney under Sec. 74-23(b). An owner who does not sign up and pay within 30 calendar days of that notice is fined $50.00 per week the violation continues, up to a $200.00 cap, with the cumulative fine added to the owner's tax bill and secured by a recorded lien in the parish mortgage office.

Bulk Item Disposal

Lafayette requires white goods and other bulky waste to be set out exactly as the current LCG collection contract specifies; if the hauler can't find a scrap dealer to strip freon and PCB oils from an old appliance first, the homeowner must pay a certified provider to do it. Only LCG-authorized haulers may collect bulky items curbside.

Setting bulky waste or white goods out in a way that doesn't match the current LCG contract, or having an unauthorized hauler collect it, breaches Secs. 74-40 and 74-42. Chapter 74 assigns no stand-alone fine for these sections, so violations default to Lafayette's general penalty under Sec. 1-9(c): a fine up to $500, up to six months' imprisonment, or both, with each continuing day counted as a separate offense.

Pickup Rules & Schedules

In Lafayette's service area, only LCG's authorized contractor or its own employees may collect solid waste, yard waste, white goods and recyclables; residents must otherwise follow the current LCG hauling contract for how waste is set out and disposed of.

Collecting waste without LCG authorization violates Sec. 74-42 and is enforced under Chapter 74's general penalty scheme (Sec. 74-23(e)): a fine of up to $1,000.00 and/or imprisonment up to 30 days, with each day of a continuing violation treated as a separate offense, plus possible civil injunctive relief and cost recovery by LCG under Sec. 74-23(d).

Recycling Requirements

Inside the City of Lafayette, curbside recycling collection is mandatory and billed alongside trash service; the mandate and its service charge apply city-only, not parish-wide, and scavenging set-out recyclables is a fineable offense.

The Bottom Line
