Petaluma's Trash & Recycling: The Rules That Matter

By CityRuleLookup Editorial Team

Every city handles trash & recycling a little differently. In Petaluma, California, there are 11 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Bulk Item Disposal

Cleanup, remodeling, and construction debris in Petaluma must go into a permitted debris box, defined in PMC § 8.16.010(E) as a container of at least ninety-seven gallons. Only haulers holding both a city business license and a non-exclusive franchise agreement under § 8.16.115 may place or collect debris boxes anywhere in the city.

Key details: Debris box size: 97 gallons or greater capacity. Allowed materials: Cleanup, construction, demolition, commercial recyclables. Hauler must hold: City business license plus franchise agreement. Franchise approved by: City council resolution, not ordinance. Penalty: Misdemeanor, up to $1,000 or 6 months.

Placing or hauling debris boxes without a city business license and the required non-exclusive franchise agreement violates PMC § 8.16.115(A). Chapter 8.16's general violations clause, § 8.16.110, makes any collection or removal of debris contrary to the chapter's provisions a misdemeanor, punishable by a fine of up to $1,000, imprisonment in the county jail for up to six months, or both, enforced through the city's Chapter 1.10 through 1.15 code enforcement procedures.

Illegal Dumping

Petaluma bans dumping sweepings, garbage, weeds, dirt or any refuse into streets, gutters, sidewalks, vacant lots or private premises anywhere in the city. PMC § 8.12.010 makes the act unlawful outright, and companion sections separately bar depositing debris on any lot or discharging waste into the Petaluma River.

Key details: Illegal to dump: Sweepings, garbage, weeds, dirt, refuse. Covers: Streets, gutters, sidewalks, lots, private premises. River dumping: Separately banned, public nuisance (§8.12.030). Default penalty: Misdemeanor, up to $1,000 or 6 months. Infraction option: $100 first offense, $200 second.

Dumping onto a public street, gutter, sidewalk, or vacant lot violates § 8.12.010; depositing debris on any lot or street without council consent for fill violates § 8.12.020. PMC § 1.12.020 sets the code's default penalty: a misdemeanor punishable by a fine up to $1,000, up to six months in county jail, or both, or, if charged as an infraction, fines of $100 for a first offense and $200 for a second within one year before a third becomes a misdemeanor.

This is one of the stricter rules in Petaluma's municipal code. If you are unsure whether your situation complies, it is worth checking with the city before proceeding.

Dumpster Rules

Every Petaluma home and business must keep a watertight metal garbage container of no more than thirty gallons, capped at 125 pounds loaded, under PMC § 8.16.180. Section 8.16.200 then fixes exactly where it sits for pickup: within five feet of the rear property line if there's an alley, or twenty feet of the rear of the building if not.

Key details: Container material: Watertight metal, tight-fitting cover. Max capacity: 30 gallons. Max loaded weight: 125 pounds. Placement (alley): Within 5 ft of rear property line. Placement (no alley): Within 20 ft of rear of building.

Keeping garbage in a container that is not metal, watertight, or within the thirty-gallon and 125-pound limits violates PMC § 8.16.160 and § 8.16.180; placing a container outside the five-foot alley zone or twenty-foot no-alley zone violates § 8.16.200. These violations fall under the chapter's general misdemeanor penalty at § 8.16.110: a fine of up to $1,000, imprisonment in county jail for up to six months, or both, enforced through Chapters 1.10 through 1.15 code enforcement.

Pickup Rules & Schedules

Petaluma requires residential garbage and rubbish to be collected at least once a week, and only between 6:00 a.m. and 6:00 p.m., under PMC § 8.16.320. The rule covers single-family homes as well as apartments, flats and multi-family buildings, with pickup timed so containers never sit full.

Key details: Minimum frequency: At least once per week. Collection hours: 6:00 a.m. to 6:00 p.m.. Covers: Single-family homes and multi-family buildings. Ownership transfer: Materials become collector's once placed out (§8.16.330). Scavenging: Banned except by city or collector (§8.16.340).

A collector servicing residential accounts outside the required weekly-minimum, 6:00 a.m. to 6:00 p.m. schedule, or anyone unlawfully accessing a receptacle placed for collection, violates PMC §§ 8.16.320 and 8.16.340. Both are enforced under the chapter's general misdemeanor penalty at § 8.16.110: a fine of up to $1,000, imprisonment in county jail for up to six months, or both.

Collection Schedule

Petaluma requires every property owner and occupant in the city to receive garbage collection service, whether the structure is existing, newly built, or changing occupants. PMC § 8.16.205 finds that citywide periodic collection protects public health and safety, and bills the cost to the owner or occupant at council-set rates.

Key details: Service is: Mandatory for all owners and occupants. Applies to: Existing, new, and newly-occupied structures. Delivered under: City's exclusive collection contract (§8.16.090). Rates set by: City council resolution. Nonpayment: Breach of contract, possible nuisance declaration.

Chapter 8.16 does not let a property opt out of collection: PMC § 8.16.205 makes service mandatory for every owner and occupant, and unpaid charges do not excuse the obligation. Continued accumulation of garbage or rubbish while in default on collection fees is declared a nuisance under PMC § 8.16.300, and enforcement of the chapter generally proceeds under the city's Chapter 1.10 through 1.16 code enforcement and administrative citation authority.

Holiday Pickup Schedule

Petaluma's code carves Sundays and legal holidays out of its daily commercial garbage rule. PMC § 8.16.310 requires perishable-food businesses like restaurants, markets and hotels to have their garbage collected every day except Sundays and holidays, between five a.m. and five p.m., a different schedule than the weekly rule that applies to homes.

Key details: Applies to: Perishable-food businesses (restaurants, markets, hotels). Frequency: Daily except Sundays and legal holidays. Hours: 5:00 a.m. to 5:00 p.m.. General business rate rule: Also excludes Sundays and holidays (§8.16.210). Residential holiday shift: Not specified in the sections reviewed.

A perishable-food business that fails to have garbage collected on the daily schedule required by § 8.16.310, or a hauler that collects on a day or at hours the section does not authorize, violates Chapter 8.16 and is punishable as a misdemeanor under PMC § 8.16.110: a fine of up to $1,000, imprisonment in county jail for up to six months, or both, enforced through the city's Chapter 1.10 through 1.15 code enforcement procedures.

Recycling Rules

Once you set garbage, rubbish or recyclable material out in a container designated for pickup, Petaluma Municipal Code transfers ownership to the city's exclusive garbage collector on the spot. You keep the right to fish an item back out only until the truck actually empties the receptacle, and nobody but the collector or a city agent may open that bin without your written say-so.

Key details: Ownership shifts at: placement in designated receptacle. Retrieval window: until collector empties container. Scavenging by others: prohibited without written consent. Source ordinance: Ordinance 2142 NCS, 2003. Collector's authority: exclusive citywide under §8.16.050.

Unauthorized scavenging from a garbage, rubbish or recycling receptacle is a violation of Chapter 8.16, enforceable the way other chapter violations are handled citywide, through the code's general nuisance and code-enforcement remedies in Chapters 1.10 through 1.16, which range from an administrative notice to an infraction citation. Interfering with a properly placed receptacle without written consent carries the same exposure.

Yard Waste Collection

Petaluma's garbage collector picks up garden and tree trimmings at the curb, but only within fixed limits: tree branches can't exceed two inches in diameter or five feet in length and must be tied and bound, while garden trimmings need to fit in a box or carton. Both go on the planting strip or within five feet of the street right-of-way, or next to the can where alleys are used.

Key details: Tree trimming diameter limit: 2 inches maximum. Tree trimming length limit: 5 feet maximum, tied and bound. Garden trimmings: boxed or cartoned for pickup. Placement: planting strip or within 5 ft of right-of-way. Alley exception: trimmings placed near garbage can.

Trimmings that exceed the two-inch diameter or five-foot length limit, or that are not tied and bound, or that are left outside the planting strip or five-foot right-of-way zone, fall outside what Sections 8.16.020 and 8.16.030 require the collector to take, and non-compliant piles left at the curb can be treated as an unlawful accumulation of rubbish under the chapter's general nuisance provisions.

Mandatory Organics Recycling

Petaluma requires every single-family generator to subscribe to the city's organic waste collection service and sort food scraps and other green-container organic waste away from recyclables and trash, implementing the state's SB 1383 mandate locally. Green container gets food waste, blue container gets recyclables, and gray container gets everything else; mixing them into the wrong bin is itself a violation.

Key details: Implements: state SB 1383 (2016). Subscription required: all single-family organic waste generators. Three-container sorting: green, blue, gray containers. Self-hauler exemption: Municipal Code § 8.18.100. Enforcement escalation: 3rd contamination notice in 3 months.

Enforcement under Section 8.18.150 starts with a notice, typically a cart tag, when a generator's container holds prohibited contaminants; a third notice within three months lets the city issue a formal notice of violation under Section 1.14.020. Failure to correct other violations after a notice of violation can escalate to an administrative citation and fine set by council resolution under Section 1.16.030.

Compared to other cities, Petaluma takes a harder line on mandatory organics recycling. The enforcement and penalty structure reflects that.

Recycling Requirements

Petaluma businesses and multifamily properties must subscribe to the city's three-container collection service and set up enough labeled bins for employees and customers to sort recyclables into the blue container, implementing the state's mandatory commercial recycling law. The city can require businesses to increase their service level and periodically inspects containers for contamination.

Key details: Implements: state AB 341 (2011). Who must subscribe: commercial businesses, multifamily dwellings. Service type: three-container: blue, green, gray. Container access: required for employees and customers. Tenant education deadline: within 14 days of occupancy.

A commercial business that fails to subscribe to the three-container service, fails to provide adequate labeled recycling containers, or that mixes recyclable material into the gray container in violation of Section 8.18.050 is subject to the notice-of-violation and administrative citation process in Section 8.18.150, following the same escalation used for contamination and other Chapter 8.18 violations.

Bin Placement Rules

Petaluma requires garbage and rubbish receptacles to stay covered except when in use, and placed within five feet of the rear property line where there's a rear alley, or within twenty feet of the rear of the building where there isn't, during the time set for collection.

Key details: Placement (with alley): Within 5 ft of rear property line. Placement (no alley): Within 20 ft of rear of building. Covering: Kept covered except when in use. Container limit: 30-gallon capacity, 125 lb max loaded. Residential collection window: 6 a.m. to 6 p.m..

An uncovered, misplaced, or leaking receptacle violates the specific placement and covering standards of PMC §§8.16.190-8.16.200. Continued accumulation of garbage or rubbish outside a conforming container after a lapse in service is declared a nuisance and an infraction under §8.16.300, punishable under §1.04.060; collecting or hauling waste in the city without the contracted hauler or a §8.16.120 permit is a misdemeanor carrying up to a $1,000 fine or six months in jail under §8.16.110.
