Winter Haven's Trash & Recycling: The Rules That Matter

Every city handles trash & recycling a little differently. In Winter Haven, Florida, there are 6 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Dumpster Rules

Every commercial and multi-family development in Winter Haven must provide a dedicated solid waste collection area, and any dumpster placed there has to be screened from public roads, rights-of-way and nearby residential zoning under ULDC Sec. 21-174. The Solid Waste Division inspects and approves the pad, access drive and enclosure before a dumpster goes into service.

In practice the Solid Waste Division withholds approval to place or replace a dumpster until the pad, access and screening pass inspection, which is the main enforcement lever before a fine is pursued.

Illegal Dumping

Winter Haven bars anyone from scattering, throwing, placing, or depositing litter, including yard waste, junk, and building debris, on public or private property where it can be carried by wind, rain, or water. Sec. 12-59 makes dumping litter within city limits unlawful, and violations are punishable under the Code's general penalty of up to $500 per day.

Scattering, throwing, or depositing litter, junk, or construction debris anywhere in Winter Haven where wind, rain, or water can carry it onto public or private property violates Sec. 12-59. It is unlawful whether the litter is dumped from a vehicle, dropped by a pedestrian, or swept into a gutter under Sec. 12-63. Because the litter article sets no dedicated fine, violations are punished under the general penalty in Sec. 1-13, up to $500 per day, with each day a separate offense; contested cases go to the city's code enforcement board.

Collection Schedule

Winter Haven runs its own residential garbage collection under Code of Ordinances Sec. 14-35, picking up trash at least once a week on a fixed city route. If a holiday falls on the regular pickup day, the truck comes the next day instead of skipping the stop, and the rest of that week's schedule shifts to match. Commercial accounts run on their own weekly-to-six-times-a-week schedule.

Any collection-schedule violation without its own listed fine falls back on Sec. 1-13's general penalty: up to $500, with every day the violation continues counted as a separate offense.

Bulk Item Disposal

Discarded furniture, appliances and tires do not go out with the regular cart in Winter Haven: Sec. 14-35 treats them as a special pickup billed at the rate on file with the city clerk, and any nonhorticultural pile is capped at ten cubic yards per pickup. Tires can never go inside a regular refuse container at all under Sec. 14-39.

A bulky-item pile that exceeds the ten-cubic-yard cap, or tires left in or around a regular container, gets the container marked inaccessible under Sec. 14-36(b): the crew leaves it, and the customer either waits for the next scheduled route or pays the special-pickup fee on the rate schedule to have it cleared sooner.

Yard Waste Collection

Winter Haven picks up horticultural refuse (tree branches, palm fronds, brush) once a week in loads up to two cubic yards under Sec. 14-35(b), so long as pieces run no more than four inches thick and five feet long, palm fronds excepted. Sec. 14-42 also requires yard waste to be kept separate from household trash, or the city can charge a sorting fee.

Mixing horticultural and non-horticultural refuse, or piling more than two cubic yards at the curb, converts the load to a billed special pickup under Sec. 14-35(b); if the city has to sort a mixed pile itself, Sec. 14-42 adds a separate sorting fee from the fee schedule on top of that special-pickup charge.

Bin Placement Rules

Winter Haven residents must put garbage carts at the property edge next to the street, not behind an obstacle or inside a building, and containers can go out no earlier than 5 p.m. the evening before pickup and must come back in by 10 a.m. the following day. A container left out or hidden past the window gets tagged by the city as a warning before any fee applies.

If the container is not brought into compliance after that warning, Sec. 14-37 authorizes an additional charge under the rate schedule on file in the city clerk's office, on top of whatever the fee schedule sets for the underlying service.
