El Monte's Zoning Overlays & Bonuses: The Rules That Matter
Every city handles zoning overlays & bonuses a little differently. In El Monte, California, there are 2 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.
Density Bonus Law
El Monte grants density bonuses of up to 50 percent above a project's base allowable units for developments of five or more units that reserve a share of housing for very low, lower, or moderate income households, following the state's density bonus law formula.
Key details: Minimum project size: 5+ multiple-family or mixed-use units. Max density bonus: 50% above base allowable units. Very low income trigger: 5% of units yields a 20% bonus. Application: Director-level zoning clearance. Required: Recorded affordability agreement before permit.
Density bonus is a benefit program, not a prohibition, so there is no standalone penalty section in Chapter 17.100. If a developer fails to honor the recorded affordability agreement required under Section 17.100.030.B, that breach is enforceable as a condition of the underlying land use entitlement: Section 17.10.160.C makes violating any condition imposed on an entitlement a misdemeanor punishable under Chapter 1.24, and the city may pursue abatement or injunctive relief under Section 17.10.160.D-E.
Downtown Design Guide
El Monte's Downtown Specific Plan applies a full set of architectural design guidelines, Chapter 17.134, to new construction and rehabilitation within the Main Street, Zócalo, Station and Monte Vista subareas. Section 17.134.070 governs historic compatibility, sustainability, building form, materials, lighting and awnings, and every downtown project reviewed by the city must meet these standards before permits issue.
Key details: Governing chapter: EMMC Title 17, Chapter 17.134, Downtown Specific Plan. Applies to: Main Street, Zócalo, Station and Monte Vista subareas. Awning clearance: Minimum 8 feet above ground level. Awning repair window: Repair or replace within 3 months of damage. Barrel awnings: Prohibited throughout the Downtown Specific Plan.
Failing to meet these design standards blocks site plan and building permit approval, since Section 17.134.070 conditions must be satisfied before the Community Development Director or Planning Commission signs off on a downtown project. Once built, an awning left ripped or tattered past the three-month repair window under 17.134.070(H)(9) is itself a code violation, and a barrel awning or a chain link screening fence installed in violation of 17.134.070(H)(10) or (J)(2) is subject to the same design-guideline enforcement as any other nonconforming zoning feature in the plan area.
The Bottom Line
El Monte's zoning overlays & bonuses rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming El Monte is broadly strict or permissive.
