An enforcement officer can issue a civil citation naming the specific code section violated, and the city may also pursue abatement, an injunction or a damages action in the same proceeding rather than only collecting the fine.

Density Bonus Law

Iowa City lets detached single-family and zero lot line homes build at higher density in the RS-5, RS-8, RS-12, and RNS-12 zones when garage and parking access comes off an alley or private rear lane. Code section 14-2A-7.A trades that alley access for smaller minimum lot width, frontage, lot size, and front setback.

Building at the reduced bonus dimensions without actually restricting garage and parking access to an alley or private rear lane, or without meeting the required utility placement and first-floor elevation, is a Zoning Code violation because the property no longer qualifies for the bonus and must instead meet the base dimensional standards in Table 2A-2. Building permits are reviewed against these standards before issuance, and a structure built out of compliance is subject to enforcement as a municipal infraction under City Code section 1-4-2, with escalating civil penalties for each day the violation continues.
