Mount Vernon's Zoning Overlays & Bonuses: The Rules That Matter
Every city handles zoning overlays & bonuses a little differently. In Mount Vernon, New York, there are 2 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.
Downtown Design Guide
Projects in Mount Vernon's Downtown Transit Oriented Arts District must be designed under a form-based code that judges approval against specific practices for facades, signage, lighting and building services. City Code Section 267-27.3.G sets these standards for the district added March 26, 2025.
Key details: District: Downtown Transit Oriented Arts District (DTOAD). Added: March 26, 2025. Code structure: Form-based code, Subsection G design guidelines. Mandatory items: ADA-compliant, lit functional entries. Review body: Planning Board site plan review.
Because DTOAD approval is conditioned on compliance with Section 267-27.3.G, a project that fails to screen trash facilities and HVAC equipment from public view, omits required storefront transparency, or leaves functional entries without ADA access or adequate lighting can be found nonconforming during Planning Board site plan review under Section 267-27.3.H, delaying or blocking approval until the design is revised.
Density Bonus Law
In the MX-1 Commercial Corridor District, Mount Vernon lets a developer apply to the Planning Board for a density bonus of two, three, or five extra stories in exchange for public amenities worth at least about 0.5% of total project cost, capped so total building height never exceeds eight stories.
Key details: Applies to: MX-1 Commercial Corridor District only. Max bonus tiers: 2, 3, or 5 extra stories. Overall height cap: 8 stories including any bonus. Amenity cost floor: About 0.5% of total development cost. Approving body: Planning Board (discretionary).
There is no per-project entitlement to a density bonus. If a developer builds extra stories the Planning Board has not approved under Β§ 267-19.A(6), that excess height becomes a Chapter 267 zoning violation enforced under Β§ 267-56: a fine up to $1,000, imprisonment up to 15 days, or both, per conviction, each day counted separately, plus a stop-work order and possible removal of the unauthorized floors.
The Bottom Line
Mount Vernon's zoning overlays & bonuses rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Mount Vernon is broadly strict or permissive.
