Orlando's Zoning Overlays & Bonuses: The Rules That Matter

Every city handles zoning overlays & bonuses a little differently. In Orlando, Florida, there are 2 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Density Bonus Law

Orlando allows density and intensity bonuses above the base zoning maximum in Office, Mixed Residential-Office, Mixed Use, and Activity Center districts, but City Code § 58.1101 caps every bonus at the least of doubling the base entitlement, the next future-land-use tier, or 200 dwelling units per acre, and Council can deny it outright.

Key details: Eligible districts: O-1/2/3, MXD-1/2, MU-1/2, AC-N/1/2/3/3A. Density cap: 200 dwelling units/acre max, except AC-3A. Approval path: Master plan or planned development rezoning. Not a right: Council may deny or reduce a requested bonus. AC-3A extra: Public art fee capped at 0.01% cost per 1% bonus.

There is no numeric penalty; the consequence of failing the criteria is that Council may approve only a lesser bonus or deny the bonus request entirely, per Sec. 58.1101(a). A project built beyond its approved bonus, or that violates conditions attached to a granted bonus (including the AC-3A public art requirement of Sec. 58.1105), is enforceable as a violation of its master plan or planned development zoning approval under the City's general code enforcement provisions.

Downtown Design Guide

Development in Orlando's AC-3A downtown district must clear Appearance Review Board (ARB) review under City Code § 62.500, and any building inside the mapped Downtown Facade Guidelines Area (Figure 46) must follow the Facade Design Guidelines the Downtown Development Board adopted under § 62.503. Parking garages fronting Pedestrian Streets face added design rules, and the AC-3A district itself carries no general height cap.

Key details: ARB review required: AC-3A downtown/CRA projects (§62.500). Facade Guidelines Area: follows Downtown Development Board guidelines (§62.503). Parking garage active use: 75% of Zone A ground floor (§62.502). Alt. garage setback: 20 ft. landscaped, outside Zone A. AC-3A height cap: none generally (§62.501).

Building or altering a facade inside the Downtown Facade Guidelines Area without following the Downtown Development Board's Facade Design Guidelines, or completing AC-3A construction without the required ARB review under § 62.500, means the project can't receive design approval. The ARB and Planning Official can withhold sign-off, require revised plans, or refer noncompliant parking-garage frontages back for redesign until the 75%-active-use or setback standards of § 62.502 are met.
