Zoning Overlays & Bonuses in Waukegan, IL: What Residents Actually Need to Know

By CityRuleLookup Editorial Team

If you live in Waukegan or are thinking about moving there, zoning overlays & bonuses are one of those things you probably won't think about until they affect you directly. Waukegan has 2 specific rules on the books covering different aspects of zoning overlays & bonuses, and some of them might surprise you.

Downtown Design Guide

Waukegan's Unified Development Ordinance imposes downtown-specific design rules on signs: materials are limited to painted wood, stained brick, glass and metal, internally lit cabinet and neon signs are strictly prohibited, and signs must sit within the storefront's sign band above the entry.

Key details: Governing section: UDO Sec. 12.06, Downtown and Lakefront District Signs. Allowed materials: Painted wood, stained brick, glass, metal. Banned lighting: Internally lit cabinet/box signs and neon. Sign height cap: 80% of sign band height or 18 inches. Variance authority: Planning and Zoning Commission, Sec. 4.04.

A downtown sign that violates the material, lighting, or dimensional limits of Sec. 12.06 is treated as a code violation subject to the Building Commissioner's enforcement and the UDO's general remedies, and it cannot be lawfully erected or maintained without first obtaining a variance from the Planning and Zoning Commission under Section 4.04; unauthorized internally lit cabinet, box, or neon signage in the downtown district is barred even with a permit application, since Sec. 12.06.B.4 flatly prohibits that lighting type in the district.

Density Bonus Law

Waukegan's Unified Development Ordinance grants a real density bonus through conservation and cluster subdivision design: lot sizes in the R2 District can shrink up to 50 percent and R3 lots up to 25 percent below the normal minimum, packing more units onto the same land in exchange for dedicated common open space.

Key details: R2 lot-size reduction: Up to 50% below the zoning minimum. R3 lot-size reduction: Up to 25% below the zoning minimum. Conservation open space required: At least 40% of subdivision land. Cluster open space required: At least 25% of subdivision land. Cluster minimum site size: 5 acres.

Because the density bonus is granted through the subdivision approval itself rather than as a standalone permit, noncompliance is addressed at the plat and construction-document stage: a final plat that does not meet the Sec. 7.03 open-space, lot-size, and common-open-space management-plan requirements cannot be recorded, and a building permit will not issue for lots platted in violation of the consolidation and dimensional rules in Section 6 and Section 7 of the UDO.

The Bottom Line

Waukegan's zoning overlays & bonuses rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Waukegan is broadly strict or permissive.

Keep in mind that Waukegan can amend these rules at any council meeting. For the most current version of any rule mentioned here, check the specific ordinance page, where we track updates as they happen.
