Full Breakdown

Under Clark County Code § 22.02.190(F), a platform or deck built in conjunction with a single-family dwelling skips the building permit only if it stays 30 inches or less above grade, walkways and driveways get the same 30-inch pass under § 22.02.190(E). Nothing on that exemption list covers patio covers, so any roofed patio structure, and any deck over 30 inches, needs a permit under the general rule in § 22.02.165. Attached patio covers in residential zoning districts also have to clear the setback table in Title 30 § 30.02.25, as close as 3 feet from the rear lot line in RS5.2/RS3.3/RS2 districts, out to 17 feet in RS80/RS40/RS20.

Violations & Fines

Building without the required permit is a misdemeanor under § 22.02.160: up to a $1,000 fine, six months in jail, or both, with each day of continued unpermitted work counted as a separate offense.

Frequently Asked Questions

Do I need a permit to build a deck in Clark County?
Only if it's more than 30 inches above grade. Decks and platforms at or under that height, built with a single-family home, are exempt under Code § 22.02.190(F).
Does a patio cover need a permit?
Yes. Patio covers aren't on the county's permit-exempt list, so a building permit is required under § 22.02.165 no matter the size, plus setbacks under Title 30.
