Summary

In unincorporated Rowan County, no one is allowed to start, alter, move, or demolish a building without a written permit from the codes enforcement supervisor. The only exception is work costing $100 or less that leaves structural parts, stairways, elevators, fire escapes, or other exits untouched. Where a home cannot connect to city sewer, septic approval from the health board is required first.

These county ordinances apply to unincorporated areas of Rowan County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a)Building permit. No person shall commence or proceed with the construction, reconstruction, alteration, repair, movement to another site, removal or demolition of any building or other structure, or any part thereof, without a written permit therefor from the codes enforcement supervisor; provided, however, that no building permit shall be required for work the total cost of which does not exceed one hundred dollars ($100.00) and which does not involve any change of the structural parts or the stairways, elevators, fire escapes or other means of egress of the building or the structure in question. Local boards of health approval of property for septic tank shall be required where the sewage system cannot be connected to a city sewer.

Full Breakdown

Sec. 7-108(a) bars anyone from commencing or proceeding with the construction, reconstruction, alteration, repair, movement, removal, or demolition of a building or other structure without a written permit from the codes enforcement supervisor. The only carve-out is work totaling $100 or less that involves no change to structural parts, stairways, elevators, fire escapes, or other means of egress; even then, a septic system that cannot connect to city sewer still needs local board of health approval. Applying for any permit requires a written application under Sec.

7-109 giving the owner's and any contractor's name and address, plus proof of the contractor's state licensing certificate where required. Detailed plans and specifications must accompany the application whenever estimated cost exceeds $20,000, per Sec. 7-110. Sec. 7-112 tightens things further at that same $20,000 threshold: the permit cannot issue unless a licensed general contractor performs the work, and for anything besides a one- or two-family dwelling, the plans must bear a registered architect's or engineer's state seal. Fees are set under Sec. 7-115 based on estimated project cost, kept on schedule in the building inspector's office.

Once issued, a permit under Sec. 7-116 expires six months after issuance if work has not begun, or immediately if started work is discontinued for twelve months, and no further work may resume until a new permit is secured.

Violations & Fines

Starting or continuing covered work without a building permit, or after a permit has expired under Sec. 7-116, violates Chapter 7 and can draw a stop-work order under Sec. 7-85. The codes enforcement supervisor may also revoke a permit under Sec. 7-118 for a material departure from the approved plans, false statements made to obtain it, or failure to comply with a lawful order.

Frequently Asked Questions

When do I need a building permit in unincorporated Rowan County?
Sec. 7-108(a) requires a written permit from the codes enforcement supervisor before you construct, reconstruct, alter, repair, move, remove, or demolish any building or structure. The only exemption is work costing $100 or less that does not touch structural parts, stairways, elevators, fire escapes, or other means of egress.
How long is a Rowan County building permit good for?
Under Sec. 7-116, a permit expires six months after issuance if the authorized work has not started, and it expires immediately if started work is then discontinued for twelve months. Once a permit expires, no further work may resume until a new permit is secured.
Does a big project need architect-sealed plans?
Yes. Sec. 7-112 bars issuing a building permit for work estimated over $20,000 unless a licensed general contractor performs it, and for anything other than a one- or two-family dwelling over that amount, the plans must carry the seal of a registered architect or engineer.
