Full Breakdown
Under the Providence Zoning Ordinance's accessory-structure rules (Section 1302.A), any accessory structure needs a building permit unless the ordinance lists it as exempt, and decks and patios are not on that exemption list (unlike apiaries, chicken coops, or coldframes, which are explicitly excused). Table 13-2 additionally sets a deck 4 feet from all lot lines, bars decks from the front yard, and allows only limited encroachment (up to 6 feet into interior/corner side setbacks, 8 feet into the rear). Patios are capped at 1 foot above grade and may encroach up to 6 feet into the front, interior side, or corner side setback.
Violations & Fines
The building official can order stop-work on an unpermitted deck or patio and require it be removed or brought into compliance through after-the-fact permitting before it's allowed to remain.
