Full Breakdown
030, adopted by Ordinance 25-015 on March 19, 2025 and effective March 30, 2025, sets six performance standards for day care centers countywide plus extra siting rules in specific residential zones. 01 SCC, with the director or hearing examiner able to add conditions at project approval to keep noise in check. 055 adds a specific buffer: a day care center in an urban or rural residential zone that abuts R-5, R-9,600, R-8,400, R-7,200, T, LDMR or MR zoning must plant 20 feet of Type A landscaping, the densest screening category in the county code, along that shared property line.
32E SCC. Every center must also hold the required license from the Washington State Department of Children, Youth, and Families (DCYF); the county code does not issue its own separate childcare license. Centers sited in the SA-1, R-12,500, R-20,000, R-9,600, R-8,400, R-7,200, and WFB zones face added road-access rules unless the center is part of a school or place of worship: the site must front a road classified as a principal, minor, or collector arterial in the comprehensive plan's transportation element, or take access from a non-arterial road only where that access sits near an intersection with the same arterial the site fronts, with continuous frontage running the whole way.
Violations & Fines
A day care center that opens without the fencing, landscaping, or DCYF license required by SCC 30.28.030 is operating in violation of the land use code. Planning and Development Services can issue a warning notice and pursue enforcement under chapter 30.85 SCC, which lets the county suspend or revoke the permit issued for the site under SCC 30.85.300 or 30.85.310 for noncompliance, in addition to any action DCYF itself takes against the facility's state license.
