Unincorporated Snohomish County regulates day care centers as a distinct land use under SCC 30.28.030. Outdoor play areas must be fenced or otherwise controlled, landscaping must meet chapter 30.25 SCC, and every center needs a license from the Washington State Department of Children, Youth, and Families before Planning and Development Services will sign off on the site.

Day care centers are subject to the following performance standards: (1) Outdoor play areas shall have fencing or otherwise be controlled. (2) Landscaping shall be provided consistent with chapter 30.25 SCC. (3) Activities in outdoor play areas are subject to noise control requirements of chapter 10.01 SCC. The director or hearing examiner, as appropriate, may apply conditions during project approvals to ensure noise control compliance. (4) Day care center development in an airport compatibility area is subject to the requirements of chapter 30.32E SCC. (5) Day care centers must have the required license from the Washington State Department of Children, Youth, and Families (DCYF). (6) Parking and child drop-off and pick-up areas are subject to the requirements of chapter 30.26 SCC.

Every center must also hold the required license from the Washington State Department of Children, Youth, and Families (DCYF); the county code does not issue its own separate childcare license. Centers sited in the SA-1, R-12,500, R-20,000, R-9,600, R-8,400, R-7,200, and WFB zones face added road-access rules unless the center is part of a school or place of worship: the site must front a road classified as a principal, minor, or collector arterial in the comprehensive plan's transportation element, or take access from a non-arterial road only where that access sits near an intersection with the same arterial the site fronts, with continuous frontage running the whole way.

Violations & Fines

A day care center that opens without the fencing, landscaping, or DCYF license required by SCC 30.28.030 is operating in violation of the land use code. Planning and Development Services can issue a warning notice and pursue enforcement under chapter 30.85 SCC, which lets the county suspend or revoke the permit issued for the site under SCC 30.85.300 or 30.85.310 for noncompliance, in addition to any action DCYF itself takes against the facility's state license.
