Summary

Tippecanoe County does not write its own carbon monoxide detector rule. County Code § 151.05(B) incorporates the Indiana Residential Code, 675 IAC Article 14, by reference for every building permit issued in the unincorporated county, and that state code is what sets the CO alarm requirements the Building Commissioner enforces.

These county ordinances apply to unincorporated areas of Tippecanoe County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

§ 151.05 ADOPTION OF REGULATIONS BY REFERENCE. Pursuant to I.C. 22-13-2-3(b), the rules Indiana Fire Prevention and Building Safety Commission as set out in the following Articles of Title 675 of the Indiana Administrative Code are hereby incorporated by reference in this subchapter and shall include later amendments to those Articles as the same are published in the Indiana Register or the Indiana Administrative Code with dates as fixed therein:

Full Breakdown

Chapter 151, the county's Building Code, is built around adoption rather than original drafting. C. " Division (B) names Article 14, the Indiana Residential Code, as one of the incorporated articles. Because the county adopts the Residential Code wholesale rather than copying its text into the county code, any carbon monoxide alarm placement or type requirement a builder must meet comes from that state code, not from separate county-drafted language. The Building Commissioner administers and enforces the incorporated codes for the unincorporated area, and no permit or certificate of occupancy issues without the Commissioner confirming compliance. 99(A): a fine of $100 for each violation, with every day the noncompliance continues counted as a separate offense. 14.

Violations & Fines

Failing to meet a carbon monoxide alarm standard set by the incorporated Indiana Residential Code is treated as a violation of County Code §§ 151.01 through 151.17. Under § 151.99(A), that carries a fine of $100 per violation, with each day the condition continues counted as a separate offense until it's corrected.

Frequently Asked Questions

Does Tippecanoe County have its own carbon monoxide detector law?
No. The county adopts the Indiana Residential Code by reference in § 151.05(B) instead of writing a separate rule, so the CO alarm requirement builders must meet is whatever the state Residential Code specifies, enforced here through the county's building permit process.
Who enforces the CO alarm requirement in unincorporated Tippecanoe County?
The County Building Commissioner, who administers every code incorporated under § 151.05 and will not sign off on a permit or certificate of occupancy until the incorporated Residential Code, including its alarm provisions, is met.
What's the penalty for not meeting the adopted code's alarm requirement?
Section 151.99(A) sets a $100 fine for each violation of §§ 151.01 through 151.17, and treats each day the violation continues as a separate offense, so an uncorrected issue can keep accruing fines.
