FL §399 requires every elevator to be registered with the Bureau of Elevator Safety (a division of DBPR), undergo annual safety inspection by a certified inspector, and have a current Certificate of Operation displayed inside each car. Owners must hire a licensed elevator contractor for installation, alteration, and repair. Routine maintenance must follow manufacturer specs and ASME A17.1. Many South Florida condos including high-rises in West Palm Beach, Boca Raton, Boynton Beach face significant modernization costs as elevators age. Following the 2021 Surfside collapse, FL SB 4-D (2022) increased structural inspection requirements for buildings 3+ stories that incidentally affect elevator infrastructure.
Operating without certificate: $500 fine first offense, escalating with additional violations. Operating with expired inspection: state may order shutdown. Unlicensed elevator work: third-degree felony under FL §399.13.
