Elevator inspection and maintenance in Toledo is regulated by the State of Ohio Department of Commerce Division of Industrial Compliance, not the city. Annual inspections and certificates of operation required for all non-residential elevators.
Under ORC Chapter 4105 and OAC 4101:5, the Ohio Department of Commerce Division of Industrial Compliance (Elevator Section) has exclusive jurisdiction over elevator, escalator, and conveyance inspection in Ohio. Private residential elevators in single-family homes are generally exempt. All commercial, multi-family (3 or more units), and public-use elevators must be: (1) installed under a state-issued permit; (2) inspected annually by a state-certified elevator inspector; (3) maintained by a licensed elevator contractor with a written maintenance program; (4) display a current Certificate of Operation issued by the state; (5) comply with ASME A17.1 Safety Code for Elevators and Escalators as adopted by Ohio. Toledo buildings must allow state inspectors access and post current certificates in the elevator or nearby. Elevator accidents must be reported to the Ohio Division of Industrial Compliance within 24 hours. Failure to maintain current certificate can result in the elevator being red-tagged and taken out of service.
