Bozeman, MT Building Safety: Green Building Code (2026)

Bozeman's only energy-efficiency construction standard in Chapter 10 is the International Energy Conservation Code, adopted in section 10.02.080 of the Bozeman Municipal Code. The section describes it as a nationally recognized model code for energy efficient construction of buildings. It is adopted as provided by ARM 24.301.161, the Administrative Rules of Montana provision (or its successor), and is subject to amendment or modification under section 10.02.010.

That cross-reference matters for which edition applies. The section prints the 2009 edition, but section 10.02.010(A)(1) adopts by reference the current editions of the model technical codes, with all accompanying appendices and amendments, adopted or required to be adopted by the Building Codes Bureau of the Montana Department of Labor and Industry. Under subsection A.3, amendments the bureau adopts for local government jurisdictions, including the latest editions of the model technical codes, become effective in the City of Bozeman through automatic adoption upon execution of an administrative order of the city manager, unless the order specifies a different effective date. A copy of each amendment notification is kept in the office of the city clerk.

The energy code is enforced through the building permit process, not as a stand-alone program. A building official can withhold a certificate of occupancy when a structure does not conform to any model technical code as amended by the city, and can issue a stop work order to any owner, contractor or subcontractor working under a permit on the same ground. Copies of the adopted codes are kept at the city clerk's office, 411 East Main Street, Bozeman, Montana, and at the building division.

Building division fees for permits and plan checks are set by resolution of the city commission under section 10.02.020, so the cost of the permit that carries the energy code review follows that adopted schedule.
